4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 635.2, subsection 2, Code 2017, is
2amended to read as follows:
   32.  The name and address of the surviving spouse, and the
4name and relationship of each beneficiary in a testate estate
5or known heirs in an intestate estate
.
6   Sec. 2.  Section 635.2, Code 2017, is amended by adding the
7following new subsection:
8   NEW SUBSECTION.  2A.  The name and relationship of each heir
9so far as known to the petitioner in an intestate estate.
10   Sec. 3.  APPLICABILITY.  This Act applies to petitions filed
11on or after the effective date of this Act.
12EXPLANATION
13The inclusion of this explanation does not constitute agreement with
14the explanation’s substance by the members of the general assembly.
   15This bill relates to the information required to be
16contained in petitions for administration of small estates.
   17Code chapter 635 provides for a simplified probate procedure
18for small estates, which are estates where the gross value of
19the decedent’s probate assets does not exceed $100,000. A
20petition for administration of a small estate must contain
21certain specified information, including the name and
22relationship of each beneficiary in a testate estate. The bill
23provides that the name and relationship of each beneficiary
24in a testate estate does not need to be contained in such a
25petition.
   26The bill applies to petitions filed on or after the effective
27date of this bill.
