2awareness and prevention.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 256.9, subsection 46, paragraph a, Code
22017, is amended to read as follows:
   3a.  Develop and make available to school districts,
4examples of age-appropriate, developmentally appropriate, and
5research-based materials and lists of resources which parents
6may use to teach their children to recognize unwanted physical
7and verbal sexual advances, to not make unwanted physical and
8verbal sexual advances, to effectively reject unwanted sexual
9advances, that it is wrong to take advantage of or exploit
10another person, about the dangers of sexual exploitation by
11means of the internet including specific strategies to help
12students protect themselves and their personally identifiable
13information from such exploitation, and about counseling,
14medical, and legal resources available to survivors of sexual
15abuse and sexual assault, including resources for escaping
16violent relationships. The materials and resources shall cover
 17child sexual abuse and sexual assault awareness and prevention,
18 verbal, physical, and visual sexual harassment, including
19nonconsensual sexual advances, and nonconsensual physical
20sexual contact. In developing the materials and resource list,
21the director shall consult with entities that shall include
22but not be limited to the departments of human services,
23public health, and public safety, education stakeholders,
24and parent-teacher organizations. School districts shall
25provide age-appropriate, developmentally appropriate, and
26research-based materials and a list of available community and
27internet-based resources to parents at registration and shall
28also include the age-appropriate, developmentally appropriate,
29 and research-based materials and resource list in the student
30handbook. School districts are encouraged to work with their
31communities to provide voluntary parent education sessions to
32provide parents with the skills and appropriate strategies
33to teach their children as described in this subsection.
34School districts shall incorporate the age-appropriate,
35developmentally appropriate,
and research-based materials
-1-1into relevant curricula and shall reinforce with parents and
2students
the importance of preventive measures when reasonable
3with parents and students.
4   Sec. 2.  Section 256.9, subsection 46, Code 2017, is amended
5by adding the following new paragraph:
6   NEW PARAGRAPH.  c.  Seek and use funds available to the
7department under the federal Elementary and Secondary Education
8Act of 1965, 20 U.S.C.§6301 et seq., as amended by the federal
9Every Student Succeeds Act, Pub.L.No.114-95, Tit.II,
10§§2001-2104, and Tit.IV, §§4001-4101, to provide to school
11districts with approved applications for allocations from
12such funds training for school district personnel, including
13teachers, principals, other school leaders, specialized
14instructional support personnel, and para-educators, regarding
15how to prevent and recognize child sexual abuse and regarding
16child sexual abuse awareness and prevention programs or
17activities, such as programs or activities designed to provide
18age-appropriate and developmentally appropriate instruction
19for students in child sexual abuse awareness and prevention,
20including how to recognize child sexual abuse and how to safely
21report child sexual abuse, and to provide information for
22parents and guardians of students about child sexual abuse
23awareness and prevention, including how to recognize child
24sexual abuse and how to discuss child sexual abuse with a
25child.
26   Sec. 3.  Section 272.2, Code 2017, is amended by adding the
27following new subsection:
28   NEW SUBSECTION.  20.  Adopt rules establishing that
29continuing education requirements for issuance, renewal, or
30upgrade of a license may include participating in or presenting
31at in-service training programs on child sexual abuse and
32sexual assault awareness and prevention.
33   Sec. 4.  Section 279.50, Code 2017, is amended by adding the
34following new subsection:
35   NEW SUBSECTION.  2A.  The human growth and development
-2-1curriculum shall include age-appropriate, developmentally
2appropriate, and research-based instruction for students in
3child sexual abuse and sexual assault awareness and prevention,
4including how to recognize child sexual abuse and sexual
5assault and how to safely report child sexual abuse and sexual
6assault.
7   Sec. 5.  STATE MANDATE FUNDING SPECIFIED.  In accordance
8with section 25B.2, subsection 3, the state cost of requiring
9compliance with any state mandate included in this Act shall
10be paid by a school district from state school foundation aid
11received by the school district under section 257.16. This
12specification of the payment of the state cost shall be deemed
13to meet all of the state funding-related requirements of
14section 25B.2, subsection 3, and no additional state funding
15shall be necessary for the full implementation of this Act
16by and enforcement of this Act against all affected school
17districts.
18EXPLANATION
19The inclusion of this explanation does not constitute agreement with
20the explanation’s substance by the members of the general assembly.
   21This bill relates to child sexual abuse and sexual assault
22awareness and prevention by directing the board of educational
23examiners to adopt rules establishing that continuing education
24requirements for issuing, renewing, or upgrading of a license
25may include but are not limited to participating in or
26presenting at in-service training programs on child sexual
27abuse and sexual assault awareness and prevention. The bill
28also requires school districts to provide instruction in child
29sexual abuse and sexual assault awareness and prevention
30as part of its human growth and development curriculum in
31kindergarten through grade 12.
   32Currently, the director of the department of education has a
33duty to develop and make available to school districts examples
34of age-appropriate and research-based materials. The bill
35specifies that the materials and resources shall also cover
-3-1child sexual abuse and sexual assault awareness and prevention.
   2The director is also directed to seek and use funds available
3to the department under the federal Elementary and Secondary
4Education Act of 1965, as amended by the federal Every
5Student Succeeds Act, Pub.L.No.114-95, to provide to school
6districts with approved applications for allocations from such
7funds training for school district personnel regarding child
8sexual abuse and sexual assault awareness.
   9The bill may include a state mandate as defined in Code
10section 25B.3. The bill requires that the state cost of
11any state mandate included in the bill be paid by a school
12district from state school foundation aid received by the
13school district under Code section 257.16. The specification
14is deemed to constitute state compliance with any state mandate
15funding-related requirements of Code section 25B.2. The
16inclusion of this specification is intended to reinstate the
17requirement of political subdivisions to comply with any state
18mandates included in the bill.
