3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 648.5, Code 2017, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  4A.  The notice requirements of this section
4shall be deemed to have been satisfied if the defendant appears
5at the hearing.
6EXPLANATION
7The inclusion of this explanation does not constitute agreement with
8the explanation’s substance by the members of the general assembly.
   9This bill relates to notice requirements for actions for
10forcible entry and detainer.
   11Under current law, in an action for forcible entry and
12detainer, the plaintiff must serve the defendant with notice as
13specified in Code section 648.5 and not less than three days
14prior to the hearing. A default judgment cannot be entered
15against the defendant if the original notice was not served in
16accordance with the requirements of Code section 648.5.
   17The bill provides that if the defendant appears at the
18hearing, the notice requirements shall be deemed to have been
19satisfied.
