3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 388.6, Code 2017, is amended to read as
2follows:
3388.6 Discrimination in rates — exceptions.
41. A city utility or a combined utility system may not
5provide use or service at a discriminatory rate, except to the
6city or its agencies, as provided in section 384.91.
72. Notwithstanding subsection 1, a city utility or a
8combined utility system may provide use or service at a reduced
9rate to persons who are at least sixty-five years of age or
10older.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
14Current Code section 388.6 prohibits city utilities and
15combined utility systems from providing discriminatory rates to
16customers, except to cities or its agencies.
17This bill authorizes city utilities and combined utility
18systems to provide use or service at a reduced rate to persons
19who are at least 65 years of age or older.
