Senate File 160 - IntroducedA Bill ForAn Act 1relating to licensing fees collected by the board of
2educational examiners and deposited in the general fund of
3the state, and including effective date provisions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 272.10, subsections 2 and 3, Code 2017,
2are amended to read as follows:
   32.  Licensing fees are payable to the treasurer of state and
4shall be deposited with the executive director of the board.
5The executive director shall deposit twenty-five percent of
6the fees collected annually with the treasurer of state and
7the fees shall be credited to the general fund of the state.

8 The remaining licensing fees collected during the fiscal year
9shall be retained by and are appropriated to the board for
10the purposes related to the board’s duties. Notwithstanding
11section 8.33, licensing fees retained by and appropriated to
12the board pursuant to this section that remain unencumbered or
13unobligated at the close of the fiscal year shall not revert
14but shall remain available for expenditure for the activities
15of the board as provided in this chapter until the close of the
16succeeding fiscal year.
   173.  The executive director shall keep an accurate and
18detailed account of licensing fees received, including fees
19paid to the treasurer of state
and fees retained by the board.
20   Sec. 2.  BOARD OF EDUCATIONAL EXAMINERS LICENSING FEE
21REDUCTION FOR 2017-2018 — EMERGENCY RULES.
   221.  The board of educational examiners shall reduce, for the
23fiscal year beginning July 1, 2017, the licensing fees assessed
24under chapter 272 by not less than twenty-five percent of the
25licensing fees established by rule and assessed during the
262016-2017 fiscal year.
   272.  The board of educational examiners may adopt emergency
28rules under section 17A.4, subsection 3, and section 17A.5,
29subsection 2, paragraph “b”, to implement the provisions of
30this Act and the rules shall be effective immediately upon
31filing unless a later date is specified in the rules. Any
32rules adopted in accordance with this section shall also be
33published as a notice of intended action as provided in section
3417A.4.
35   Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
-1-1immediate importance, takes effect upon enactment.
2EXPLANATION
3The inclusion of this explanation does not constitute agreement with
4the explanation’s substance by the members of the general assembly.
   5This bill eliminates a provision that requires the director
6of the board of educational examiners to deposit with the
7treasurer of state 25 percent of the licensing fees collected
8by the board. Under the provision, the moneys deposited are
9credited to the general fund of the state. The bill also
10requires the board to reduce its fees by 25 percent for the
112017-2018 fiscal year. The board may adopt emergency rules to
12implement the fee reduction.
   13The bill takes effect upon enactment.
