3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 15E.116, Code 2017, is amended to read
2as follows:
   315E.116  Iowa wine, and beer, and spirits promotion board.
   4An Iowa wine, and beer, and spirits promotion board is
5created. The board consists of three four members appointed
6by the director of the economic development authority. Each
7member shall serve a term of two years on the board. One member
8shall represent the authority, one member shall represent the
9Iowa wine makers, and one member shall represent the Iowa beer
10makers, and one member shall represent the Iowa micro-distilled
11spirits makers
. The board shall advise the authority on the
12best means to promote wine, and beer, and spirits made in Iowa.
13   Sec. 2.  Section 15E.117, Code 2017, is amended to read as
14follows:
   1515E.117  Promotion of Iowa wine, and beer, and spirits.
   161.  The economic development authority shall consult with
17the Iowa wine, and beer, and spirits promotion board on the
18best means to promote wine, and beer, and spirits made in Iowa.
   192.  The authority has the authority to contract with private
20persons for the promotion of beer, and wine, spirits made in
21Iowa.
   223.  Moneys appropriated to the authority pursuant to
23sections 123.17, 123.143, and 123.183 may be used by the
24authority for the purposes of this section, including
25administrative expenses incurred under this section.
26   Sec. 3.  Section 123.17, Code 2017, is amended by adding the
27following new subsection:
28   NEW SUBSECTION.  5A.  After any transfer provided for
29in subsection 3 is made, there is appropriated from the
30beer and liquor control fund to the economic development
31authority for purposes of section 15E.117 a sum of moneys
32equal to the markup, as determined pursuant to section 123.24,
33on micro-distilled spirits sold by the division that are
34manufactured in this state by a class “A” micro-distilled
35spirits permittee which owns and operates a micro-distillery
-1-1located in Iowa.
2   Sec. 4.  Section 123.17, subsection 6, Code 2017, is amended
3to read as follows:
   46.  After any transfers or appropriations provided for in
5subsections 3, and 5, and 5A, the department of commerce shall
6transfer to the division from the beer and liquor control
7fund and before any other transfer to the general fund, an
8amount sufficient to pay the costs incurred by the division for
9collecting and properly disposing of the liquor containers.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill concerns the promotion of micro-distilled spirits
14made in this state.
   15Code section 15E.116, establishing the Iowa wine and beer
16promotion board, is amended to add spirits and rename the board
17the Iowa wine, beer, and spirits promotion board. The bill
18also adds an additional member to the board who represents Iowa
19micro-distilled spirits makers.
   20Code section 15E.117, providing for the promotion of wine
21and beer in Iowa, is amended by adding spirits.
   22Code section 123.17, concerning the beer and liquor control
23fund, is amended by providing that a sum of moneys equal to
24the markup on Iowa manufactured micro-distilled spirits sold
25by the alcoholic beverages division shall be appropriated from
26the beer and liquor control fund to the economic development
27authority to be used for the promotion of Iowa wine, beer, and
28spirits as provided in Code section 15E.117.
