Senate Study Bill 1211 - IntroducedA Bill ForAn Act 1making appropriations to the economic development
2authority, the Iowa finance authority, the public employment
3relations board, the department of workforce development,
4and the state board of regents and certain regents
5institutions, and providing for properly related matters.
6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  GOALS AND ACCOUNTABILITY — ECONOMIC
2DEVELOPMENT.
   31.  For the fiscal year beginning July 1, 2023, the goals
4for the economic development authority shall be to expand and
5stimulate the state economy, increase the wealth of Iowans, and
6increase the population of the state.
   72.  To achieve the goals in subsection 1, the economic
8development authority shall do all of the following for the
9fiscal year beginning July 1, 2023:
   10a.  Concentrate its efforts on programs and activities that
11result in commercially viable products and services.
   12b.  Adopt practices and services consistent with free
13market, private sector philosophies.
   14c.  Ensure economic growth and development throughout the
15state.
   16d.  Work with businesses and communities to continually
17improve the economic development climate along with the
18economic well-being and quality of life for Iowans.
   19e.  Coordinate with other state agencies to ensure that they
20are attentive to the needs of an entrepreneurial culture.
   21f.  Establish a strong and aggressive marketing image to
22showcase Iowa’s workforce, existing industry, and potential.
23A priority shall be placed on recruiting new businesses,
24business expansion, and retaining existing Iowa businesses.
25Emphasis shall be placed on entrepreneurial development through
26helping entrepreneurs secure capital, and developing networks
27and a business climate conducive to entrepreneurs and small
28businesses.
   29g.  Encourage the development of communities and quality of
30life to foster economic growth.
   31h.  Prepare communities for future growth and development
32through development, expansion, and modernization of
33infrastructure.
   34i.  Develop public-private partnerships with Iowa businesses
35in the tourism industry, Iowa tour groups, Iowa tourism
-1-1organizations, and political subdivisions in this state to
2assist in the development of advertising efforts.
   3j.  Develop, to the fullest extent possible, cooperative
4efforts for advertising with contributions from other sources.
5   Sec. 2.  ECONOMIC DEVELOPMENT AUTHORITY.
   61.  APPROPRIATION
   7a.  There is appropriated from the general fund of the state
8to the economic development authority for the fiscal year
9beginning July 1, 2023, and ending June 30, 2024, the following
10amount, or so much thereof as is necessary, to be used for the
11purposes designated in this subsection, and for not more than
12the following full-time equivalent positions:

   15b.  (1)  For salaries, support, miscellaneous purposes,
16programs, marketing, and the maintenance of an administration
17division, a business development division, a community
18development division, a small business development division,
19and other divisions the authority may organize.
   20(2)  For business development operations and programs,
21international trade, export assistance, workforce recruitment,
22and the partner state program.
   23(3)  For transfer to a fund created pursuant to section
2415.313 for purposes of financing strategic infrastructure
25projects.
   26(4)  For community economic development programs, tourism
27operations, community assistance, plans for Iowa green corps
28and summer youth programs, the main street and rural main
29street programs, the school-to-career program, the community
30development block grant, and housing and shelter-related
31programs.
   32(5)  For achieving the goals and accountability, and
33fulfilling the requirements and duties required under this Act.
   34(6)  The full-time equivalent positions authorized under
35this section are funded, in whole or in part, by the moneys
-2-1appropriated under this subsection or by other moneys received
2by the authority, including certain federal moneys.
   3c.  Notwithstanding section 8.33, moneys appropriated in
4this subsection that remain unencumbered or unobligated at the
5close of the fiscal year shall not revert but shall remain
6available for expenditure for the purposes designated in this
7subsection until the close of the succeeding fiscal year.
   82.  FINANCIAL ASSISTANCE RESTRICTIONS
   9a.  A business creating jobs through moneys appropriated in
10subsection 1 shall be subject to contract provisions requiring
11new and retained jobs to be filled by individuals who are
12citizens of the United States who reside within the United
13States, or any person authorized to work in the United States
14pursuant to federal law, including legal resident aliens
15residing in the United States.
   16b.  Any vendor who receives moneys appropriated in
17subsection 1 shall adhere to such contract provisions and
18provide periodic assurances as the state shall require that the
19jobs are filled solely by citizens of the United States who
20reside within the United States, or any person authorized to
21work in the United States, pursuant to federal law, including
22legal resident aliens residing in the United States.
   23c.  A business that receives financial assistance from
24the authority from moneys appropriated in subsection 1 shall
25only employ individuals legally authorized to work in this
26state. In addition to all other applicable penalties provided
27by current law, all or a portion of the assistance received
28by a business which is found to knowingly employ individuals
29not legally authorized to work in this state is subject to
30recapture by the authority.
   313.  USES OF APPROPRIATIONS
   32a.  From the moneys appropriated in subsection 1, the
33authority may provide financial assistance in the form of a
34grant to a community economic development entity for conducting
35a local workforce recruitment effort designed to recruit former
-3-1citizens of the state and former students at colleges and
2universities in the state to meet the needs of local employers.
   3b.  From the moneys appropriated in subsection 1, the
4authority may provide financial assistance to early stage
5industry companies being established by women entrepreneurs.
   6c.  From the moneys appropriated in subsection 1, the
7authority may provide financial assistance in the form of
8grants, loans, or forgivable loans for advanced research and
9commercialization projects involving value-added agriculture,
10advanced technology, or biotechnology.
   11d.  The authority shall not use any moneys appropriated in
12subsection 1 for purposes of providing financial assistance for
13the Iowa green streets pilot project or for any other program
14or project that involves the installation of geothermal systems
15for melting snow and ice from streets or sidewalks.
   164.WORLD FOOD PRIZE
17In lieu of the standing appropriation in section 15.368,
18there is appropriated from the general fund of the state to the
19economic development authority for the fiscal year beginning
20July 1, 2023, and ending June 30, 2024, the following amount
21for the world food prize:

   235.  COUNCILS OF GOVERNMENTS — ASSISTANCE
   24There is appropriated from the general fund of the state
25to the economic development authority for the fiscal year
26beginning July 1, 2023, and ending June 30, 2024, the following
27amount to be used for the purposes of providing financial
28assistance to Iowa’s councils of governments:

   306.  BUTCHERY INNOVATION AND REVITALIZATION PROGRAM
   31a.  There is appropriated from the general fund of the state
32to the economic development authority for the fiscal year
33beginning July 1, 2023, and ending June 30, 2024, the following

35purposes designated:

18promoting, placement, and implementation of the economic
19development authority’s strategic plan for tourism and travel:

   21b.  Notwithstanding section 8.33, moneys appropriated in
22this subsection that remain unencumbered or unobligated at the
23close of the fiscal year shall not revert but shall remain
24available for expenditure for the purposes designated until the
25close of the succeeding fiscal year.
   26c.  The economic development authority shall submit an
27annual report on or before January 15 to the general assembly
28regarding the tourism office’s activities funded with moneys
29appropriated under this subsection. The report shall be
30provided in an electronic format and shall include metrics
31and criteria that allow the general assembly to quantify
32and evaluate the effectiveness and economic impact of the
33tourism office’s activities related to advertising, promoting,
34placement, and implementation of the economic development
35authority’s strategic plan for tourism and travel.

   18.  SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS
2INTERNSHIPS
   3a.  There is appropriated from the Iowa skilled worker and
4job creation fund created in section 8.75 to the economic
5development authority for the fiscal year beginning July 1,
62023, and ending June 30, 2024, the following amount, or so
7much thereof as is necessary, to be used for the purposes
8designated:
   9For the funding of internships for students studying in the
10fields of science, technology, engineering, and mathematics
11with eligible Iowa employers as provided in section 15.411,
12subsection 3, paragraph “c”:

15subsection may be used by the authority for costs associated
16with administration of the internship program.

   229.  STEM BEST AND EMPOWER RURAL IOWA

24job creation fund created in section 8.75 to the economic
25development authority for the fiscal year beginning July 1,
262023, and ending June 30, 2024, the following amounts, or so
27much thereof as is necessary, to be used for the purposes
28designated:

   3c.  The authority shall adopt rules pursuant to chapter
417A to establish criteria for the distribution of the moneys
5appropriated in this subsection.
   610.  CULTURAL AFFAIRS ACTIVITIES
   7a.  There is appropriated from the general fund of the state
8to the economic development authority for the fiscal year
9beginning July 1, 2023, and ending June 30, 2024, the following
10amounts, or so much thereof as is necessary, to be used for the
11purposes designated:
   12(1)  For salaries, support, maintenance, and miscellaneous
13purposes, and for not more than the following full-time
14equivalent positions for the administration of cultural affairs
15activities:

5   Sec. 3.  LIMITATIONS OF STANDING APPROPRIATIONS — FY
62023-2024.
  Notwithstanding the standing appropriations
7in the following designated sections for the fiscal year
8beginning July 1, 2023, and ending June 30, 2024, the amounts
9appropriated from the general fund of the state pursuant to
10those sections for the following purposes shall not exceed the
11following amounts:
   121.  For operational support grants and community cultural
13grants under section 99F.11, subsection 4, paragraph “d”,
14subparagraph (1):

19   Sec. 4.  FINANCIAL ASSISTANCE REPORTING — ECONOMIC
20DEVELOPMENT AUTHORITY.
  The economic development authority
21shall submit an annual report to the general assembly no later
22than November 1, 2023, that details the amount of every direct
23loan, forgivable loan, tax credit, tax exemption, tax refund,
24grant, or any other financial assistance awarded to a person
25during the prior fiscal year by the authority under an economic
26development program administered by the authority. The report
27shall identify the county where the project associated with
28each such award is located.
29   Sec. 5.  INSURANCE ECONOMIC DEVELOPMENT.  From the
30moneys collected by the insurance division in excess of the
31anticipated gross revenues under section 505.7, subsection
323, during the fiscal year beginning July 1, 2023, $________
33shall be transferred to the economic development authority for
34insurance economic development and international insurance
35economic development.

1   Sec. 6.  IOWA FINANCE AUTHORITY.
   21.  There is appropriated from the general fund of the state
3to the Iowa finance authority for the fiscal year beginning
4July 1, 2023, and ending June 30, 2024, the following amount,
5or so much thereof as is necessary, to be used to provide
6reimbursement for rent expenses to eligible persons under
7the home and community-based services rent subsidy program
8established in section 16.55:

17   Sec. 7.  IOWA FINANCE AUTHORITY AUDIT.  The auditor of state
18is requested to review the audit of the Iowa finance authority
19performed by the auditor hired by the authority.
20   Sec. 8.  PUBLIC EMPLOYMENT RELATIONS BOARD.
   211.  There is appropriated from the general fund of the state
22to the public employment relations board for the fiscal year
23beginning July 1, 2023, and ending June 30, 2024, the following
24amount, or so much thereof as is necessary, to be used for the
25purposes designated:
   26For salaries, support, maintenance, and miscellaneous

3workforce development shall use the same application process
4and criteria as are used for purposes of awarding grants to
5community colleges for the purpose of adult basic education
6programs for students requiring instruction in English as a
7second language using moneys that are appropriated to the
8department from the Iowa skilled worker and job creation fund.
   97.  FUTURE READY IOWA REGISTERED APPRENTICESHIP DEVELOPMENT
10PROGRAM
   11For the funding of the future ready Iowa registered
12apprenticeship development program under chapter 15C, as
13amended by 2023 Iowa Acts, Senate File 514, to encourage
14small to midsize businesses to start or grow registered
15apprenticeships:

22   Sec. 10.  GENERAL FUND — EMPLOYEE MISCLASSIFICATION
23PROGRAM.
  There is appropriated from the general fund of the
24state to the department of workforce development for the fiscal
25year beginning July 1, 2023, and ending June 30, 2024, the
26following amount, or so much thereof as is necessary, to be
27used for the purposes designated:

29misclassify workers, and for not more than the following
30full-time equivalent positions:

33   Sec. 11.  SPECIAL EMPLOYMENT SECURITY CONTINGENCY FUND.
   341.  There is appropriated from the special employment
35security contingency fund created in section 96.13 to the

2beginning July 1, 2023, and ending June 30, 2024, the following
3amount, or so much thereof as is necessary, to be used for
4field offices:

11   Sec. 12.  UNEMPLOYMENT COMPENSATION RESERVE FUND — FIELD
12OFFICES.
  Notwithstanding section 96.9, subsection 8, paragraph
13“e”, there is appropriated from interest earned on the
14unemployment compensation reserve fund created in section 96.9
15to the department of workforce development for the fiscal year
16beginning July 1, 2023, and ending June 30, 2024, the following
17amount, or so much thereof as is necessary, to be used for the
18purposes designated:
   19For the operation of field offices:

21   Sec. 13.  VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES.  The
22department of workforce development shall require a unique
23identification login for all users of workforce development
24centers operated through electronic means.
25   Sec. 14.  UNEMPLOYMENT COMPENSATION PROGRAM.  Notwithstanding
26section 96.9, subsection 4, paragraph “a”, moneys credited to
27the state by the secretary of the treasury of the United States
28pursuant to section 903 of the federal Social Security
29Act are appropriated to the department of workforce
30development and shall be used by the department for the
31administration of the unemployment compensation program only.
32This appropriation shall not apply to any fiscal year
33beginning after December 31, 2023.
34   Sec. 15.  IOWA SKILLED WORKER AND JOB CREATION FUND.
   351.  There is appropriated from the Iowa skilled worker and
-13-1job creation fund created in section 8.75 to the following
2departments, agencies, and institutions for the fiscal year
3beginning July 1, 2023, and ending June 30, 2024, the following
4amounts, or so much thereof as is necessary, to be used for the
5purposes designated:
   6a.  ECONOMIC DEVELOPMENT AUTHORITY
   7(1)  For the purposes of providing assistance as described in
8section 15.335B for the high quality jobs program:

   10From the moneys appropriated in this subparagraph, the
11economic development authority may use not more than $________
12for purposes of providing infrastructure grants to main
13street communities under the main street Iowa program and may
14allocate not more than $________ for the purposes of supporting
15statewide worker education and quality preapprenticeship
16programs.
   17(2)  As a condition of receiving moneys appropriated in
18this lettered paragraph “a”, an entity shall testify upon the
19request of the joint appropriations subcommittee on economic
20development regarding the expenditure of such moneys.
   21b.  STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
   22(1)  STATE BOARD OF REGENTS. For capacity building
23infrastructure in areas related to technology
24commercialization, marketing and business development
25efforts in areas related to technology commercialization,
26entrepreneurship, and business growth, and infrastructure
27projects and programs needed to assist in implementation of
28activities under chapter 262B:

   30(a)  Of the moneys appropriated pursuant to this
31subparagraph (1), 35 percent shall be allocated for Iowa state
32university of science and technology, 35 percent shall be
33allocated for the state university of Iowa, and 30 percent
34shall be allocated for the university of northern Iowa.
   35(b)  The institutions shall provide a one-to-one match
-14-1of additional moneys for the activities funded with moneys
2appropriated under this subparagraph (1).
   3(c)  The state board of regents shall submit a report by
4January 15, 2024, to the governor and the general assembly
5regarding the activities, projects, and programs funded with
6moneys appropriated under this subparagraph (1). The report
7shall be provided in an electronic format and shall include a
8list of metrics and criteria mutually agreed to in advance by
9the board of regents and the economic development authority.
10The metrics and criteria shall allow the governor’s office and
11the general assembly to quantify and evaluate the progress
12of the board of regents institutions with regard to their
13activities, projects, and programs in the areas of technology
14commercialization, entrepreneurship, regional development, and
15market research.
   16(2)  IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
17small business development centers, the research park, and the
18center for industrial research and service, and for not more
19than the following full-time equivalent positions:

   22(a)  Of the moneys appropriated in this subparagraph (2),
23Iowa state university of science and technology shall allocate
24at least $________ for purposes of funding small business
25development centers. Iowa state university of science and
26technology may allocate the appropriated moneys to the various
27small business development centers in any manner necessary to
28achieve the purposes of this subparagraph.
   29(b)  Iowa state university of science and technology shall
30do all of the following:
   31(i)  Direct expenditures for research toward projects that
32will provide economic stimulus for Iowa.
   33(ii)  Provide emphasis to providing services to Iowa-based
34companies.
   35(c)  It is the intent of the general assembly that the
-15-1industrial incentive program focus on Iowa industrial sectors
2and seek contributions and in-kind donations from businesses,
3industrial foundations, and trade associations, and that moneys
4for the center for industrial research and service industrial
5incentive program shall be allocated only for projects which
6are matched by private sector moneys for directed contract
7research or for nondirected research. The match required of
8small businesses as defined in section 15.102 for directed
9contract research or for nondirected research shall be $1
10for each $3 of state funds. The match required for other
11businesses for directed contract research or for nondirected
12research shall be $1 for each $1 of state funds. The match
13required of industrial foundations or trade associations shall
14be $1 for each $1 of state funds.
   15(d)  Iowa state university of science and technology shall
16report annually to the general assembly the total amount of
17private contributions, the proportion of contributions from
18small businesses and other businesses, and the proportion for
19directed contract research and nondirected research of benefit
20to Iowa businesses and industrial sectors.
   21(3)  STATE UNIVERSITY OF IOWA.
   22(a)  For the state university of Iowa research park and for
23university of Iowa pharmaceuticals located at the research
24park, including salaries, support, maintenance, equipment, and
25miscellaneous purposes, and for not more than the following
26full-time equivalent positions:

   29The state university of Iowa shall do all of the following:

   26c.  DEPARTMENT OF WORKFORCE DEVELOPMENT
   27(1)  To develop a long-term sustained program to train
28unemployed and underemployed central Iowans with skills
29necessary to advance to higher-paying jobs with full benefits:

19education and literacy programs pursuant to section 84A.19, as
20enacted by 2023 Iowa Acts, Senate File 514.
   21(c)  From the moneys appropriated in this numbered

23grants to community colleges for the purpose of adult basic
24education programs for students requiring instruction in
25English as a second language. The department of workforce
26development shall establish an application process and criteria
27to award grants pursuant to this subparagraph division to
28community colleges. The criteria shall be based on need for
29instruction in English as a second language in the region
30served by each community college as determined by factors
31including data from the latest federal decennial census and
32outreach efforts to determine regional needs.
   33(d)  From the moneys appropriated in this numbered
34subparagraph, $_____ shall be transferred to the department
35of health and human services for purposes of administering a
-18-1program to provide access to international resources to Iowans
2and new Iowans to provide economic and leadership development
3resulting in Iowa being a more inclusive and welcoming place
4to live, work, and raise a family. The program shall provide
5supplemental support services for international refugees to
6improve learning, English literacy, life skills, cultural
7competencies, and integration in a county with a population
8over 350,000 as determined by the 2020 federal decennial
9census. The department of health and human services shall
10utilize a request for proposals process to identify the entity
11best qualified to implement the program.
   12(4)  For deposit in the statewide work-based learning
13intermediary network fund created pursuant to section 256.40,
14as amended by 2023 Iowa Acts, Senate File 514:

33or unobligated at the close of the fiscal year shall not revert
34but shall remain available for expenditure for the purposes

1EXPLANATION
2The inclusion of this explanation does not constitute agreement with
3the explanation’s substance by the members of the general assembly.
   4This bill appropriates moneys for FY 2023-2024 from
5the general fund of the state to the economic development
6authority, the Iowa finance authority, the public employment
7relations board, the department of workforce development,
8Iowa state university of science and technology, the state
9university of Iowa, and the university of northern Iowa.
   10The bill appropriates moneys for FY 2023-2024 from the
11Iowa skilled worker and job creation fund to the economic
12development authority, the department of workforce development,
13and the state board of regents and institutions under the
14control of the board.
   15For FY 2023-2024, the bill limits standing appropriations
16for the world food prize, certain operational support grants,
17community cultural grants, and regional tourism marketing.
   18The bill transfers $________ of the moneys collected by the
19insurance division in excess of the anticipated gross revenues
20under Code section 505.7 to the economic development authority.
   21The bill appropriates moneys for FY 2023-2024 from the
22special employment security contingency fund and interest
23earned on the unemployment compensation reserve fund to the
24department of workforce development.
   25Moneys credited to the state by the U.S. secretary of
26treasury pursuant to section 903 of the federal Social
27Security Act are appropriated to the department of workforce
28development.
   29The auditor of state is requested to review the audit of the
30Iowa finance authority performed by the auditor hired by the
31authority.
   32The bill requires the economic development authority, the
33vocational rehabilitation services division of the department
34of workforce development, the state board of regents, and Iowa
35state university of science and technology to submit various
