3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 282.18, subsection 8, paragraph b, Code
22023, is amended to read as follows:
   3b.  (1)  A receiving district may send school vehicles more
4than two miles
into the district of residence of the pupil
5using the open enrollment option under this section, for the
6purpose of transporting the pupil to and from school in the
7receiving district, if the boards of both the sending and
8receiving districts agree to this arrangement.
   9(2)  A receiving district may send school vehicles not more
10than two miles into the district of residence of the pupil
11using the open enrollment option under this section, for the
12purpose of transporting the pupil to and from school in the
13receiving district, without entering into an agreement with the
14board of the sending district.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill relates to the transportation to and from school
19of pupils participating in open enrollment. Current law
20authorizes a receiving school district to send school vehicles
21into the district of residence of a pupil who open enrolls,
22for the purpose of transporting the pupil to and from school
23in the receiving school district, if the boards of directors
24of the sending school district and receiving school district
25agree to this arrangement. The bill strikes the requirement
26that the boards of directors of the sending school district and
27receiving school district agree to the arrangement in cases
28where the receiving district’s school vehicles do not travel
29more than two miles into the pupil’s district of residence.
