2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 692.1, subsection 7, Code 2023, is
2amended to read as follows:
   37.  “Criminal or juvenile justice agency” means an agency
4or department of any level of government or an entity wholly
5owned, financed, or controlled by one or more such agencies
6or departments, or a federally recognized Indian tribe,
7 which performs as its principal function the apprehension,
8prosecution, adjudication, incarceration, or rehabilitation of
9criminal or juvenile offenders.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill relates to criminal history and intelligence data.
   14The bill provides that a “criminal or juvenile justice
15agency” includes a federally recognized Indian tribe
16which performs as its principal function the apprehension,
17prosecution, adjudication, incarceration, or rehabilitation
18of criminal or juvenile offenders. Under current law, the
19department of public safety may provide copies or communicate
20information from criminal history data to a criminal or
21juvenile justice agency. Criminal history data includes data
22concerning arrests, convictions, dispositions, corrections,
23adjudications, and custody.
