4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 137F.6, subsection 1, paragraphs c and h,
2Code 2023, are amended to read as follows:
   3c.  For a temporary food establishment for multiple
4nonconcurrent events during a calendar year, one annual
5license fee of two hundred dollars for each establishment on
6a countywide statewide basis.
   7h.  For a farmers market where time/temperature control for
8safety food is sold or distributed, one annual license fee
9of one hundred fifty dollars for each vendor on a countywide
10
 statewide basis.
11   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
12importance, takes effect upon enactment.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill provides for the licensure of certain food
17establishments under the regulatory jurisdiction of the
18department of inspections and appeals (DIA) or a political
19subdivision that has entered into a contract with DIA (together
20termed a “regulatory authority”) under Code chapter 137F.
21Specifically, the bill amends provisions for a temporary food
22establishment that operates for not more than 14 consecutive
23days in conjunction with a single event and at multiple
24nonconcurrent events during a calendar year (Code sections
25137F.1 and 137F.6). The license fee is $200. A farmers market
26is subject to regulation as a food establishment if its vendor
27sells unpackaged foods that must be temperature controlled such
28as meat, poultry, dairy products, cooked or prepared foods,
29or soft pies requiring refrigeration (see 481 IAC 31.5). The
30license fee is $150. In each case, the license is valid on a
31countywide basis. The bill amends Code section 137F.6(1) by
32providing that the license is valid on a statewide basis.
   33The bill takes effect upon enactment.
