3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 272.2, subsection 14, paragraph b,
2subparagraph (2), Code 2023, is amended by striking the
3subparagraph.
4   Sec. 2.  Section 272.12, Code 2023, is amended to read as
5follows:
   6272.12  Para-educator certificates.
   7The board of educational examiners shall adopt rules
8pursuant to chapter 17A relating to a voluntary certification
9system for para-educators. The rules shall specify rights,
10responsibilities, levels, and qualifications for the
11certificate. Applicants shall be disqualified for any reason
12specified in section 272.2, subsection 14, or in administrative
13rule. Notwithstanding section 272.2, subsection 14, paragraph
14“b”, subparagraph (2), the
 The board may issue a para-educator
15certificate to a person who is at least eighteen years of age.
16A person holding a para-educator certificate shall not perform
17the duties of a licensed practitioner. A certificate issued
18pursuant to this chapter shall not be considered a teacher
19or administrator license for any purpose specified by law,
20including the purposes specified under this chapter or chapter
21279.
22EXPLANATION
23The inclusion of this explanation does not constitute agreement with
24the explanation’s substance by the members of the general assembly.
   25This bill relates to the minimum age of applicants for
26licenses from the board of educational examiners (BOEE).
27Current law requires the BOEE to adopt rules that require the
28BOEE to disqualify an applicant for a license if the applicant
29is less than 21 years of age, with certain limited exceptions.
30The bill strikes this requirement and makes conforming changes.
