4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 137F.6, subsection 1, paragraph h, Code
22023, is amended to read as follows:
   3h.  For a farmers market where time/temperature control for
4safety food is sold or distributed, one annual license fee
5of one hundred fifty dollars for each vendor on a countywide
6
 statewide basis.
7   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
8importance, takes effect upon enactment.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill provides for the statewide licensure of farmers
13markets under the regulatory jurisdiction of the department
14of inspections and appeals (DIA) or a political subdivision
15that has entered into a contract with DIA (together termed a
16“regulatory authority”) under Code chapter 137F. According
17to that chapter and rules adopted by DIA, a farmers market is
18subject to regulation as a food establishment if its vendor
19sells unpackaged foods that must be temperature controlled such
20as meat, poultry, dairy products, cooked or prepared foods,
21or soft pies requiring refrigeration (see 481 IAC 31.5). A
22regulated farmers market must operate pursuant to an annual
23license. A license fee of $150 is imposed for the issuance of
24the license, which is valid on a countywide basis (Code section
25137F.6). The bill provides that the license is valid on a
26statewide basis.
   27The bill takes effect upon enactment.
