3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 91C.1, subsection 1, Code 2023, is
2amended to read as follows:
   31.  As used in this chapter, unless the context otherwise
4requires, “contractor” means a person who engages in the
5business of construction, as the term “construction” is defined
6in the Iowa administrative code for purposes of the Iowa
7employment security law. However, a person who earns less than
8two thousand dollars annually or who performs work or has work
9performed on the person’s own property is not a contractor for
10purposes of this chapter. “Contractor” includes a labor broker
11or recruiter who brings one or more workers to a construction
12job site in this state.
The state, its boards, commissions,
13agencies, departments, and its political subdivisions including
14school districts and other special purpose districts, are not
15contractors for purposes of this chapter.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill provides that a contractor, for purposes of
20Code chapter 91C relating to registration of construction
21contractors, includes a labor broker or recruiter who brings
22one or more workers to a construction job site in Iowa.
   23Code chapter 91C provides for administrative penalties of
24not more than $500 in the case of a first violation and not more
25than $5,000 for each subsequent violation.
