6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2rebuild iowa infrastructure fund
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the fiscal year beginning July 1, 2022, and ending June
730, 2023, the following amounts, or so much thereof as is
8necessary, to be used for the purposes designated:
   91.  DEPARTMENT OF ADMINISTRATIVE SERVICES
   10a.  For safety and security on the state capitol complex,
11notwithstanding section 8.57, subsection 5, paragraph “c”:

14in section 8A.321 for purposes of maintenance of state

24salaries, support, maintenance, and miscellaneous purposes,
25notwithstanding section 8.57, subsection 5, paragraph “c”:

   27b.  (1)  The moneys appropriated in this subsection shall
28be used to support demonstration projects in subwatersheds as
29designated by the department that are part of high-priority
30watersheds identified by the water resources coordinating
31council.
   32(2)  The moneys appropriated in this subsection shall be
33used to support demonstration projects in watersheds generally,
34including regional watersheds, as designated by the division
35and high-priority watersheds identified by the water resources

   2c.  In supporting projects in watersheds and subwatersheds
3as provided in paragraph “b”, all of the following shall apply:
   4(1)  The demonstration projects shall utilize water quality
5practices as described in the latest revision of the document
6entitled “Iowa Nutrient Reduction Strategy” initially presented
7in November 2012 by the department of agriculture and land
8stewardship, the department of natural resources, and Iowa
9state university of science and technology.
   10(2)  The division shall implement demonstration projects as
11provided in subparagraph (1) by providing for participation by
12persons who hold a legal interest in agricultural land used in
13farming. To every extent practical, the division shall provide
14for collaborative participation by such persons who hold a
15legal interest in agricultural land located within the same
16subwatershed.
   17(3)  The division shall implement demonstration projects on
18a cost-share basis as determined by the division. Except for
19edge-of-field practices, the state’s share of the amount shall
20not exceed 50 percent of the estimated cost of establishing the
21practice as determined by the division or 50 percent of the
22actual cost of establishing the practice, whichever is less.
   23(4)  The demonstration projects shall be used to educate
24other persons about the feasibility and value of establishing
25similar water quality practices. The division shall promote
26field day events for purposes of allowing interested persons to
27establish water quality practices on their agricultural land.
   28(5)  The division shall conduct water quality evaluations
29within supported subwatersheds. Within a reasonable period
30after accumulating information from such evaluations, the
31division shall create an aggregated database of water quality
32practices. Any information identifying a person holding a
33legal interest in agricultural land or specific agricultural
34land shall be a confidential record.
   35d.  The moneys appropriated in this subsection shall be used
-2-1to support education and outreach in a manner that encourages
2persons who hold a legal interest in agricultural land used for
3farming to implement water quality practices, including the
4establishment of such practices in watersheds generally, and
5not limited to subwatersheds or high-priority watersheds.
   6e.  The moneys appropriated in this subsection may be used
7to contract with persons to coordinate the implementation of
8efforts provided in this subsection.
   9f.  The moneys appropriated in this subsection may be used
10by the department to support urban soil and water conservation
11efforts, which may include but are not limited to management
12practices related to bioretention, landscaping, the use of
13permeable or pervious pavement, and soil quality restoration.
14The moneys shall be allocated on a cost-share basis as provided
15in chapter 161A.
   16g.  Notwithstanding any other provision of law to the
17contrary, the department may use moneys appropriated in this
18subsection to carry out the provisions of this subsection on a
19cost-share basis in combination with other moneys available to
20the department from a state or federal source.
   21h.  Not more than 10 percent of the moneys appropriated in
22this subsection may be used for costs of administration and
23implementation of the water quality initiative administered by
24the soil conservation division.

32   Sec. 12.  EFFECTIVE DATE.  This division of this Act, being
33deemed of immediate importance, takes effect upon enactment.
34DIVISION IV
35MISCELLANEOUS PROVISIONS

1   Sec. 13.  Section 8.57C, subsection 3, paragraph a,
2subparagraph (3), Code 2022, is amended to read as follows:
   3(3)  For the fiscal year beginning July 1, 2022 2023, and for
4each subsequent fiscal year thereafter, the sum of seventeen
5million five hundred thousand dollars.
6   Sec. 14.  Section 8.57C, subsection 3, Code 2022, is amended
7by adding the following new paragraph:
8   NEW PARAGRAPH.  j.  There is appropriated from the rebuild
9Iowa infrastructure fund for the fiscal year beginning July 1,
102022, and ending June 30, 2023, the sum of twenty million five
11hundred thousand dollars to the technology reinvestment fund,
12notwithstanding section 8.57, subsection 5, paragraph “c”.
13   Sec. 15.  Section 15.261, Code 2022, is amended to read as
14follows:
   1515.261  Vacant state buildings demolition fund.
   161.  A vacant state buildings demolition fund is created in
17the state treasury under the control of the authority. The
18fund shall consist of all moneys appropriated to the fund.
   192.  Moneys in the vacant state buildings demolition fund
20are appropriated to the authority for purposes of funding a
21grant program for the demolition of vacant buildings owned by
22the state or by a county that has purchased real property from
23the federal government
which are no longer used for a state or
24federal
purpose. Grant program criteria shall provide that
25no more than fifty percent of the cost of a project for the
26demolition of vacant buildings shall be funded from a grant
27under the program. The authority shall give preference to
28applicants that have not previously been awarded money from
29this fund.

   303.  Notwithstanding section 12C.7, subsection 2, interest
31or earnings on moneys deposited in the vacant state buildings
32demolition fund shall be credited to the vacant state buildings
33demolition fund. Notwithstanding section 8.33, moneys credited
34to the vacant state buildings demolition fund shall not revert
35at the close of a fiscal year.

1   Sec. 16.  Section 15.262, Code 2022, is amended to read as
2follows:
   315.262  Vacant state buildings rehabilitation fund.
   41.  A vacant state buildings rehabilitation fund is created
5in the state treasury under the control of the authority. The
6fund shall consist of all moneys appropriated to the fund.
   72.  Moneys in the vacant state buildings rehabilitation fund
8are appropriated to the authority for purposes of funding a
9loan program for the rehabilitation or redevelopment of vacant
10buildings owned by the state or by a county that has purchased
11real property from the federal government
which are no longer
12used for a state or federal purpose. The authority shall give
13preference to applicants that have not previously been awarded
14money from this fund.

   153.  Notwithstanding section 12C.7, subsection 2, interest
16or earnings on moneys deposited in the vacant state buildings
17rehabilitation fund shall be credited to the vacant state
18 buildings rehabilitation fund. Notwithstanding section 8.33,
19moneys credited to the vacant state buildings rehabilitation
20fund shall not revert at the close of a fiscal year.
21   Sec. 17.  Section 602.11101, subsection 1, paragraph e,
22subparagraph (2), Code 2022, is amended to read as follows:
   23(2)  Until July 1, 1986, the county shall remain responsible
24for the compensation of and operating costs for court
25employees not presently designated for state financing and
26for miscellaneous costs of the judicial branch related to
27furnishings, supplies, and equipment purchased, leased, or
28maintained for the use of judicial officers, referees, and
29their staff. Effective July 1, 1986, the state shall assume
30the responsibility for the compensation of and operating costs
31for court employees presently designated for state financing
32and for miscellaneous costs of the judicial branch related to
33furnishings, supplies, and equipment purchased, leased, or
34maintained for the use of judicial officers, referees, and
35their staff. However, the county shall at all times remain
-15-1responsible for the provision of suitable courtrooms, offices,
2and other physical facilities pursuant to section 602.1303,
3subsection 1, including paint, wall covering, and fixtures in
4the facilities. In addition, however, effective July 1, 2023,
5if a county expends moneys for the renovation or construction
6of suitable courtrooms, offices, and other physical facilities
7pursuant to section 602.1303, that requires the purchase of
8furnishings, supplies, and equipment for the use of judicial
9officers, referees, and their staff as a result of that
10renovation or construction, the state shall be responsible for
11only fifty percent of the cost of the purchase.

12   Sec. 18.  DES MOINES AREA REGIONAL TRANSIT AUTHORITY
13ALTERNATIVE FUNDING ADVISORY COMMITTEE — REPORT.
   141.  The department of transportation shall establish a Des
15Moines area regional transit authority alternative funding
16advisory committee to study the most effective and efficient
17methods to increase funding for the Des Moines area regional
18transit authority that are alternative to an increase in
19property taxes.
   202.  The committee shall consist of five voting members and
21four ex officio, nonvoting members.
   22a.  The voting members of the committee shall be composed of
23all of the following:
   24(1)  The director of the department of transportation or a
25designee.
   26(2)  The director of the department of revenue or a designee.
   27(3)  A Polk county supervisor appointed by the governor.
   28(4)  A member of a city council of a city in Polk county in
29which the Des Moines area regional transit authority operates,

   31(5)  A representative of the Des Moines area regional transit
32authority appointed by the Des Moines area regional transit
33authority.
   34b.  The ex officio, nonvoting members of the committee shall
35be two state representatives, one appointed by the speaker of
-16-1the house of representatives and one by the minority leader
2of the house of representatives, and two state senators, one
3appointed by the majority leader of the senate and one by the
4minority leader of the senate.
   53.  Staffing services shall be provided by the department of
6transportation in coordination with the department of revenue.
   74.  The committee shall submit a report containing its
8findings and recommendations to the general assembly on or
9before December 15, 2022.
   105.  This section is repealed January 1, 2023.
11   Sec. 19.  EFFECTIVE DATE.  The following, being deemed of
12immediate importance, take effect upon enactment:
   13The sections of this division of this Act amending sections
1415.261 and 15.262.
15   Sec. 20.  RETROACTIVE APPLICABILITY.  The following apply
16retroactively to June 1, 2020:

19DIVISION V
20sports tourism program
21   Sec. 21.  Section 15F.401, subsections 4, 5, and 6, Code
222022, are amended to read as follows:
   234.  An applicant shall demonstrate matching funds in order
24to receive financial assistance pursuant to this section. The
25amount of matching funds that may be required shall be at the
26board’s discretion. An applicant under the program shall not
27receive financial assistance from the sports tourism program
28fund created in section 15F.403 in an amount exceeding fifty
29
 twenty-five percent of the total cost of the project.
   305.  The board shall make final funding decisions on
31each application and may approve, deny, defer, or modify
32applications for financial assistance under the program, in
33its discretion, in order to fund as many projects with the
34moneys available as possible. The board and the authority may
35negotiate with applicants regarding the details of projects
-17-1and the amount and terms of any award. The total amount of
2financial assistance provided to an applicant in any one
3fiscal year shall not exceed five hundred thousand ten million
4 dollars. In making final funding decisions pursuant to this
5subsection, the board and the authority are exempt from chapter
617A.
   76.  a.  A city, county, or public entity may use financial
8assistance received under the program for marketing and
9promotions. Whether an activity or individual cost item is
10directly related to the promotion of the sporting event shall
11be within the discretion of the authority
 infrastructure.
   12b.  All applications to the authority for financial
13assistance shall be made at least ninety days prior to an
14event’s scheduled date. A city, county, or public entity shall
15not use financial assistance received under the program as
16reimbursement for completed projects.
