3definition of accredited private institutions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 261.9, subsection 1, unnumbered
2paragraph 1, Code 2022, is amended to read as follows:
   3“Accredited private institution” means an institution of
4higher learning that was established in Iowa on or before
5January 1, 2020, that is currently
located in Iowa which, that
6 is operated privately and not controlled or administered by any
7state agency or any subdivision of the state, and which that
8 meets the criteria in paragraphs “a” and “b” and all of the
9criteria in paragraphs “d” through “i”, except that institutions
10defined in paragraph “c” of this subsection are exempt from the
11requirements of paragraphs “a” and “b”:
12   Sec. 2.  Section 261.110, subsection 3, Code 2022, is amended
13to read as follows:
   143.  Criteria for eligibility shall be established by the
15commission and shall include but are not limited to the
16following:
   17a.  The applicant was in the top twenty-five percent
18academically of students exiting a teacher preparation program
19approved by the state board of education pursuant to section
20256.7, subsection 3, or a similar teacher preparation program
21in another state, or had earned other comparable academic
22credentials.

   23b.    a.  The applicant is preparing to teach become a teacher
24who provides classroom instruction
in fields including but not
25limited to science, technology, engineering, or mathematics;
26English as a second language or special education instruction;
27or is preparing to teach in a hard-to-staff subject as
28identified by the department. The department shall take
29into account the varying regional needs in the state for
30teachers in these subject areas when applying the criterion
31of this paragraph. The department shall annually identify
32and designate hard-to-staff subjects for the purpose of this
33paragraph. The eligibility of an applicant who receives a
34teach Iowa scholar grant and who is preparing to teach in a
35hard-to-staff subject as identified by the department shall
-1-1not be affected in subsequent years if the department does not
2continue to identify that subject as a hard-to-staff subject

 any of the following located in this state:
   4(1)  A school district.
    5(2)  A charter school.
   6(3)  An area education agency.
   7(4)  An accredited nonpublic school.
   8c.    b.  The applicant met all of the eligibility requirements
9of this section on or after January 1, 2013. A person who met
10the program eligibility requirements of this section prior to
11January 1, 2013, is ineligible for this program.
      12c.  On or after July 1, 2022, the total value of grants
13awarded under this section each year to applicants who are
14preparing to become teachers who provide classroom instruction
15in a school district, charter school, area education agency, or
16an accredited nonpublic school shall be as follows:

   17(1)  Fifty percent shall be awarded to applicants preparing
18to become teachers who provide classroom instruction in a
19school district, charter school, area education agency, or
20an accredited nonpublic school, with less than or equal to
21one thousand two hundred students. However, if the amount
22requested by applicants pursuant to subparagraph (2) is less
23than the amount reserved for applicants under subparagraph (2),
24the commission may award the difference to applicants under
25this subparagraph.

   26(2)  Fifty percent shall be awarded to applicants preparing
27to become teachers who provide classroom instruction in a
28school district, charter school, area education agency, or an
29accredited nonpublic school, with greater than one thousand
30two hundred students. However, if the amount requested by
31applicants pursuant to subparagraph (1) is less than the amount
32reserved for applicants under subparagraph (1), the commission
33may award the difference to applicants under this subparagraph.
