3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 26.7, subsection 1, paragraph a, Code
22022, is amended to read as follows:
   3a.  The time, and place, and manner for filing sealed
4proposals.
5   Sec. 2.  Section 26.7, Code 2022, is amended by adding the
6following new subsection:
7   NEW SUBSECTION.  1A.  The notice to bidders may provide that
8bids may be received in an electronic format as determined by
9the governmental entity.
10   Sec. 3.  Section 26.10, subsection 1, Code 2022, is amended
11to read as follows:
   121.  The date and time that each bid is received by the
13governmental entity, together with the name of the person
14receiving the bid, shall be recorded on the envelope containing
15the bid. If bids are received in an electronic format as
16provided in section 26.7, the governmental entity shall
17electronically record the date and time each bid is received.

18 All bids received after the deadlines for submission of
19bids as stated in the project specifications shall not be
20considered and shall be returned to the late bidder unopened.
21The governmental entity shall open, announce the amount of
22the bids, and file all proposals received, at the time and
23place specified in the notice to bidders. The governmental
24entity may, by resolution, award the contract for the public
25improvement to the bidder submitting the lowest responsive,
26responsible bid, determined as provided in section 26.9, or
27the governmental entity may reject all bids received, fix a
28new date for receiving bids, and order publication of a new
29notice to bidders. The governmental entity shall retain the
30bid security furnished by the successful bidder until the
31approved contract form has been executed, a bond has been filed
32by the bidder guaranteeing the performance of the contract, and
33the contract and bond have been approved by the governmental
34entity. The provisions of chapter 573, where applicable, apply
35to contracts awarded under this chapter.
