2eighteen years of age or younger, making appropriations, and
3including effective date and applicability provisions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  279.76  Event admission fees.
   21.  For the purposes of this section:
   3a.  “Department” means the department of management.
   4b.  “Event” means an extracurricular interscholastic contest
5or competition sponsored or administered by the Iowa high
6school athletic association, Iowa girls high school athletic
7union, Iowa high school music association, or Iowa high school
8speech association, not including post-regular season and
9all-state contests or competitions.
   102.  A school district shall not charge a fee for the
11admittance of a person eighteen years of age or younger to an
12event.
   133.  The state board of education shall adopt rules that
14calculate the amount of revenue that each school district
15would have received if the school district charged fees for
16the admittance of persons eighteen years of age or younger to
17events based on budget enrollment as defined in section 257.6,
18subsection 4.
   194.  a.  Beginning July 1, 2022, there is appropriated
20annually to the department from the sports wagering receipts
21fund established under section 8.57, subsection 6, an amount
22necessary to pay the amounts calculated pursuant to subsection
233.
   24b.  The department shall distribute the moneys appropriated
25pursuant to paragraph “a” to each school district in an amount
26equal to the amount calculated pursuant to subsection 3 at
27the same time and in the same manner as foundation aid is
28paid under section 257.16, and may be included in the monthly
29payment of state aid under section 257.16, subsection 2.
   305.  The moneys provided in this section shall be deposited
31in the school district’s student activity fund established by
32section 298A.8.
33   Sec. 2.  Section 298A.8, subsection 1, Code 2022, is amended
34to read as follows:
   351.  The student activity fund is a special revenue fund.
-1-1A student activity fund must be established in any school
2corporation receiving money from student-related activities
3such as admissions, activity fees, student dues, student
4fund-raising events, or other student-related cocurricular
5or extracurricular activities, or moneys pursuant to section
6279.76
. Moneys in this fund shall be used to support only the
7cocurricular or extracurricular program defined in department
8of education administrative rules.
9   Sec. 3.  EMERGENCY RULES.  The state board of education
10may adopt emergency rules under section 17A.4, subsection 3,
11and section 17A.5, subsection 2, paragraph “b”, to implement
12the provisions of this Act and the rules shall be effective
13immediately upon filing unless a later date is specified in the
14rules. Any rules adopted in accordance with this section shall
15also be published as a notice of intended action as provided
16in section 17A.4.
17   Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of immediate
18importance, takes effect upon enactment.
19   Sec. 5.  APPLICABILITY.  This Act applies to school district
20events occurring on or after July 1, 2022.
21EXPLANATION
22The inclusion of this explanation does not constitute agreement with
23the explanation’s substance by the members of the general assembly.
   24This bill relates to high school event admission fees for
25people 18 years of age or younger.
   26The bill defines “event” as an extracurricular
27interscholastic contest or competition authorized by the Iowa
28high school athletic association, Iowa girls high school
29athletic union, Iowa high school music association, or Iowa
30high school speech association, not including post-regular
31season and all-state contests or competitions. The bill also
32defines “department” as the department of management.
   33The bill prohibits a school district from charging a fee for
34the admittance of a person 18 years of age or younger to an
35event.

   1The bill requires the state board of education to adopt rules
2that calculate the amount of revenue that a school district
3would have received if the school district charged a fee for
4the admittance of persons 18 years of age or younger to events
5based on the school district’s budget enrollment.
   6The bill makes an appropriation beginning July 1, 2022, and
7each year thereafter to the department of management from the
8sports wagering receipts fund in an amount equal to the total
9amount the state board of education has determined all school
10districts would have received if school districts charged
11people 18 years of age or younger admission fees to events.
   12The bill requires the department of management to distribute
13all moneys appropriated to the department of management from
14the sports wagering receipts fund relating to admission fees to
15each school district in an amount equal to the amount the state
16board of education has determined the school district would
17have received if it charged people 18 years of age or younger
18admission fees to events. Distributions shall be made at the
19same time and in the same manner as foundation aid and may be
20included in the monthly payment of state aid.
   21The bill allows the state board of education to adopt
22emergency rules to implement the bill.
   23The bill takes effect upon enactment.
   24The bill applies to school district events occurring on or
25after July 1, 2022.
