2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 347.9A, Code 2022, is amended by adding
2the following new subsection:
3 NEW SUBSECTION. 4. This section does not apply to
4compensation that a trustee receives pursuant to section 347.19
5in the performance of the trustee’s duties.
6 Sec. 2. Section 347.19, Code 2022, is amended to read as
7follows:
8347.19 Compensation — expenses.
9A trustee shall not may receive any compensation for
10services performed under this chapter, but and a trustee shall
11be reimbursed for actual and necessary expenses incurred in the
12performance of the trustee’s duties.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
16This bill relates to compensation for county hospital
17trustees. Under current law, after voters of a county vote
18to establish a county public hospital, the county board of
19supervisors appoints residents to serve as members of the
20hospital board of trustees. Current law prohibits a trustee
21from receiving any compensation for services performed as
22a trustee, except that a trustee shall be reimbursed for
23actual and necessary expenses incurred in the performance of
24the trustee’s duties. The bill allows a trustee to receive
25compensation for services performed as a trustee. Receiving
26compensation under the bill does not disqualify a person from
27serving as a trustee and does not qualify as a conflict of
28interest transaction.
