3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  DEPARTMENT OF HUMAN SERVICES — FOOD ASSISTANCE
2— MAXIMUM BENEFITS.
  The department of human services shall
3amend its administrative rulers pursuant to chapter 17A
4relating to categorical eligibility for food assistance
5benefits to provide that a qualified household that includes
6an individual under eighteen years of age, an individual
7sixty-five years of age or older, a disabled individual as
8defined by 42 U.S.C. §1382c, as amended, or an individual
9enrolled in an eligible institution as defined in section
10261.35, as at least a half-time student, as that term is
11defined by rule of the college student aid commission, shall
12qualify for the maximum benefit amount applicable to the
13household’s size and gross monthly income limits under 7 U.S.C.
14§2011 et seq.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill relates to qualifications for maximum benefit
19amounts from the state food assistance program.
   20The bill provides that the department of human services
21shall amend its administrative rules pursuant to Code chapter
2217A relating to categorical eligibility for food assistance
23benefits to provide that a qualified household that includes an
24individual under 18 years of age, an individual 65 years of age
25or older, a disabled individual as defined by federal social
26security laws, or an individual enrolled in a postsecondary
27educational institution which meets the requirements of the
28provisions of the federal Higher Education Act of 1965 for
29student participation in the federal interest subsidy program
30and the requirements prescribed by rule of the college student
31aid commission, as at least a half-time student, shall qualify
32for the maximum benefit amount applicable to the household’s
33size and gross monthly income limits as allowed under federal
34law.
