2eighteen years of age or younger, making appropriations, and
3including effective date and applicability provisions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  279.76  Event admission fees.
   21.  For the purposes of this section:
   3a.  “Department” means the department of management.
   4b.  “Event” means an extracurricular interscholastic contest
5or competition sponsored or administered by the Iowa high
6school athletic association, Iowa girls high school athletic
7union, Iowa high school music association, or Iowa high school
8speech association, not including post-regular season and
9all-state contests or competitions.
   102.  A school district shall not charge a fee for the
11admittance of a person eighteen years of age or younger to an
12event.
   133.  The state board of education shall adopt rules that
14calculate the amount of revenue that each school district
15would have received if the school district charged fees for
16the admittance of persons eighteen years of age or younger to
17events.
   184.  a.  Beginning July 1, 2022, there is appropriated
19annually to the department from the sports wagering receipts
20fund established under section 8.57, subsection 6, an amount
21necessary to pay the amounts calculated pursuant to subsection
223.
   23b.  The department shall distribute the moneys appropriated
24pursuant to paragraph “a” to each school district in an amount
25equal to the amount calculated pursuant to subsection 3 at
26the same time and in the same manner as foundation aid is
27paid under section 257.16, and may be included in the monthly
28payment of state aid under section 257.16, subsection 2.
   295.  The moneys provided in this section are miscellaneous
30income as defined in section 257.2, shall be deposited in the
31general fund of the school district, may be used for any school
32general fund purpose, and shall not be included in district
33cost.
34   Sec. 2.  EMERGENCY RULES.  The state board of education
35may adopt emergency rules under section 17A.4, subsection 3,
-1-1and section 17A.5, subsection 2, paragraph “b”, to implement
2the provisions of this Act and the rules shall be effective
3immediately upon filing unless a later date is specified in the
4rules. Any rules adopted in accordance with this section shall
5also be published as a notice of intended action as provided
6in section 17A.4.
7   Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of immediate
8importance, takes effect upon enactment.
9   Sec. 4.  APPLICABILITY.  This Act applies to school district
10events occurring on or after July 1, 2022.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
   14This bill relates to high school event admission fees for
15people 18 years of age or younger.
   16The bill defines “event” as an extracurricular
17interscholastic contest or competition authorized by the Iowa
18high school athletic association, Iowa girls high school
19athletic union, Iowa high school music association, or Iowa
20high school speech association, not including post-regular
21season and all-state contests or competitions. The bill also
22defines “department” as the department of management.
   23The bill prohibits a school district from charging a fee for
24the admittance of a person 18 years of age or younger to an
25event.
   26The bill requires the state board of education to adopt rules
27that calculate the amount of revenue that a school district
28would have received if the school district charged a fee for
29the admittance of persons 18 years of age or younger to events.
   30The bill makes an appropriation beginning July 1, 2022, and
31each year thereafter to the department of management from the
32sports wagering receipts fund in an amount equal to the total
33amount the state board of education has determined all school
34districts would have received if school districts charged
35people 18 years of age or younger admission fees to events.

   1The bill requires the department of management to distribute
2all moneys appropriated to the department of management from
3the sports wagering receipts fund relating to admission fees to
4each school district in an amount equal to the amount the state
5board of education has determined the school district would
6have received if it charged people 18 years of age or younger
7admission fees to events. Distributions shall be made at the
8same time and in the same manner as foundation aid and may be
9included in the monthly payment of state aid.
   10The bill allows the state board of education to adopt
11emergency rules to implement the bill.
   12The bill takes effect upon enactment.
   13The bill applies to school district events occurring on or
14after July 1, 2022.
