House Study Bill 642 - IntroducedA Bill ForAn Act 1providing for membership in a protection occupation

3including effective date and retroactive applicability
4provisions.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 97B.49B, subsection 1, paragraph e,
2subparagraph (2), Code 2022, is amended to read as follows:
   3(2)  A marshal in a city not covered under chapter 400 or a
4fire fighter or police officer of a city covered employer not
5participating in the retirement systems established in chapter
6410 or 411.
7   Sec. 2.  SERVICE RECLASSIFICATION.  Notwithstanding any
8provision of law to the contrary, a member of the Iowa public
9employees’ retirement system whose prior regular service
10position is reclassified by this Act as a protective occupation
11service position shall have service by such member prior to the
12effective date of this Act coded as service in a protection
13occupation by the Iowa public employees’ retirement system
14if certified by the employer of the member as constituting
15protection occupation service under this Act. Membership
16service shall be reclassified as provided by this Act without
17any requirement to pay additional contributions for the payment
18of the related actuarial costs of such reclassified service.
19   Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of immediate
20importance, takes effect upon enactment.
21   Sec. 4.  RETROACTIVE APPLICABILITY.  This Act applies
22retroactively to membership service under the Iowa public
23employees’ retirement system on or after July 1, 2017.
24EXPLANATION
25The inclusion of this explanation does not constitute agreement with
26the explanation’s substance by the members of the general assembly.
   27This bill provides that persons employed as a peace officer
28or fire fighter by a covered employer, and not just a city,
29under the Iowa public employees’ retirement system (IPERS)
30are included within the protection occupation category of
31IPERS. The bill provides that membership service prior
32to the effective date of the bill shall be reclassified
33as protection occupation service without payment of any
34additional contributions to pay the actuarial costs of the
35reclassified service if the employer certifies the employment
-1-1as constituting protection occupation service under the bill.
   2The bill takes effect upon enactment and applies to
3membership service under IPERS on or after July 1, 2017.
