House Study Bill 579 - IntroducedA Bill ForAn Act 1relating to public records of the Iowa public
2broadcasting board.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 256.84, Code 2022, is amended by adding
2the following new subsections:
3   NEW SUBSECTION.  9A.  All records, videos, electronic
4storage, documents, tapes, and other information or material,
5stored or preserved in any medium by the board, administrator,
6department, or any other entity on behalf of the state shall be
7considered public records as defined in chapter 22 and subject
8to examination as provided in section 22.2 unless otherwise
9deemed confidential under the provisions of section 22.7.
10   NEW SUBSECTION.  9B.  The board, administrator, department,
11or any other entity on behalf of the state shall not enforce
12the rights of the board with respect to any copyright,
13trademark, or other intellectual property right of the board
14contained in a public record identified in subsection 9A more
15than ten years after the public record was originally created,
16produced, filmed, or developed.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20This bill relates to public records of the Iowa public
21broadcasting board. The bill provides that all records,
22videos, electronic storage, documents, tapes, and other
23information or material kept in any medium by the Iowa public
24broadcasting board, administrator of the public broadcasting
25division of the department of education, department of
26education, or any other entity on behalf of the state of Iowa
27shall be public records and subject to examination unless
28deemed confidential under Code chapter 22 (Iowa’s open records
29law).
   30The bill provides that the Iowa public broadcasting board,
31administrator of the public broadcasting division of the
32department of education, department of education, or any other
33entity on behalf of the state shall not enforce the rights
34of the Iowa public broadcasting board with respect to any
35copyright, trademark, or other intellectual property right

210 years after the public record was created.
