House Study Bill 575 - IntroducedA Bill ForAn Act 1relating to the composition of a county zoning

3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 335.8, subsection 1, Code 2022, is
2amended to read as follows:
   31.  In order to avail itself of the powers conferred by this
4chapter, the board of supervisors shall appoint a commission
5consisting of eligible electors, as defined in section 39.3,
6who reside within the county, but outside the corporate limits
7of any city, to be known as the county zoning commission.
 8However, in a county with a population of less than twenty
9thousand, any eligible elector who resides within the county
10may be appointed to the commission regardless of whether the
11eligible elector resides within the corporate limits of a
12city.
The commission may recommend the boundaries of the
13various districts and appropriate regulations and restrictions
14to be enforced in the districts. The commission shall, with
15due diligence, prepare a preliminary report and hold public
16hearings on the preliminary report before submitting the
17commission’s final report. The board of supervisors shall not
18hold its public hearings or take action until it has received
19the final report of the commission. After the adoption of
20the regulations, restrictions, and boundaries of districts,
21the zoning commission may, from time to time, recommend to
22the board of supervisors amendments, supplements, changes, or
23modifications. The commission’s report and any recommendations
24may include a proposed ordinance or amendments to an ordinance.
25EXPLANATION
26The inclusion of this explanation does not constitute agreement with
27the explanation’s substance by the members of the general assembly.
   28This bill relates to the composition of a county zoning
29commission. Under current law, in order to regulate county
30zoning a county board of supervisors shall appoint a county
31zoning commission that consists of eligible electors who reside
32in the county, but outside the corporate limits of any city.
33Under the bill, an eligible elector who resides in a county
34with a population of less than 20,000 may be appointed to the
35county’s zoning commission regardless of whether the eligible
