3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  94.3  COVID-19 testing requirements
2by employers.
   31.  An employer that requires an employee to undergo routine
4COVID-19 testing as an alternative to receiving a COVID-19
5vaccine shall do all of the following:
   6a.  Pay all required COVID-19 testing expenses on behalf of
7the employee.
   8b.  If required COVID-19 testing is not conducted on the
9premises of the employer, compensate the employee for all time
10away from work necessary to undergo the required COVID-19
11testing.
   122.  An employer shall not require an employee to undergo
13required COVID-19 testing outside of the employee’s normal
14scheduled work hours.
15   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
16importance, takes effect upon enactment.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20This bill provides that an employer that requires an
21employee to undergo routine COVID-19 testing as an alternative
22to receiving a vaccine shall pay all costs of the testing and
23shall compensate the employee for all time away from work to
24undergo testing that is not conducted on the premises of the
25employer. The bill provides that an employer shall not require
26an employee to undergo testing outside of the employee’s normal
27working hours. The bill takes effect upon enactment.
