6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  280.13D  Limitation on expenditure
2of certain public moneys for high school organizations — school
3classifications.
   41.  For the purposes of this section:
   5a.  “Extracurricular interscholastic activity” means a contest
6or competition for academics, arts, music, speech, or sports
7between different schools and outside the regular scope of a
8school’s curriculum.
   9b.  “Organization” means a corporation, association,
10or organization which has as one of its primary purposes
11the sponsoring or administration of an extracurricular
12interscholastic activity, but does not include an agency of
13this state, a public or private school or school board, or an
14athletic conference or other association whose interscholastic
15contests or competitions do not include more than twenty-four
16schools.
   172.  a.  On or after January 1, 2023, a school district
18shall not expend any moneys to pay dues or membership fees
19to an organization unless the organization classifies, for
20the purposes of an extracurricular interscholastic activity,
21each nonpublic school one classification higher than the
22classification the nonpublic school would have been assigned
23based on enrollment.
   24b.  This subsection shall not apply when a nonpublic school
25is already in the classification with the largest schools
26based on enrollment or if the extracurricular interscholastic
27activity is not divided into classifications.
   28c.  This subsection shall be applied on a per extracurricular
29interscholastic activity basis.
   303.  a.  On or after January 1, 2023, an accredited or
31unaccredited nonpublic school shall not expend any moneys
32originating from the state to pay dues or membership fees
33to an organization unless the organization classifies, for
34the purposes of an extracurricular interscholastic activity,
35each nonpublic school one classification higher than the
-1-1classification the nonpublic school would have been assigned
2based on enrollment.
   3b.  This subsection shall not apply when a nonpublic school
4is already in the classification with the largest schools
5based on enrollment or if the extracurricular interscholastic
6activity is not divided into classifications.
   7c.  This subsection shall be applied on a per extracurricular
8interscholastic activity basis.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill relates to the expenditure of public moneys for
13dues or membership fees to high school organizations that do
14not meet certain requirements concerning school classifications
15for extracurricular interscholastic activities.
   16The bill defines “extracurricular interscholastic activity”
17as a contest or competition for academics, arts, music, speech,
18or sports between different schools and outside the regular
19scope of a school’s curriculum.
   20The bill defines “organization” as a corporation,
21association, or organization which has as one of its primary
22purposes the sponsoring or administration of an extracurricular
23interscholastic activity, but does not include an agency of
24this state, a public or private school or school board, or an
25athletic conference or other association whose interscholastic
26contests or competitions do not include more than 24 schools.
   27The bill prohibits a school district from expending
28any moneys to pay dues or membership fees to a high school
29organization after January 1, 2023, unless the organization
30classifies, for the purposes of extracurricular interscholastic
31activities, each nonpublic school one classification higher
32than the classification the nonpublic school would have been
33assigned based on enrollment. The bill does not apply when
34a nonpublic school is already in the classification with the
35largest schools based on enrollment or if the activity is not

2apply on a per activity basis. The bill contains a similar
3requirement for the expenditure of any moneys originating from
4the state by an accredited or unaccredited nonpublic school.
