2of certain specified concepts in school districts.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 279.74, subsection 1, Code 2022, is
2amended by adding the following new paragraph:
3   NEW PARAGRAPH.  0a.  “Administrator” means the same as
4defined in section 272.1.
5   Sec. 2.  Section 279.74, Code 2022, is amended by adding the
6following new subsection:
7   NEW SUBSECTION.  2A.  a.  An administrator shall not
8permit race or sex scapegoating, race or sex stereotyping, or
9specific defined concepts to be taught in any school that the
10administrator supervises or directs.
   11b.  In the case of an administrator’s first violation
12of paragraph “a”, the school district that employs the
13administrator shall do all of the following:
   14(1)  Provide the administrator with written notice of the
15violation. The notice shall be in writing and personally
16delivered or mailed by certified mail.
   17(2)  Provide the parents and guardians of students enrolled
18in the school with written notice of the violation and what
19actions the school district will take or has taken to prevent
20future violations. The notice shall be in writing and
21personally delivered or mailed by certified mail.
   22(3)  Provide the department of education and board of
23educational examiners with notice of the violation.
   24c.  In the case of an administrator’s second violation
25of paragraph “a”, the school district that employs the
26administrator shall do all of the following:
   27(1)  Provide the administrator with written notice of the
28violation. The notice shall be in writing and personally
29delivered or mailed by certified mail.
   30(2)  Suspend the administrator without pay for one week.
   31(3)  Provide the parents and guardians of students enrolled
32in the school with written notice of the violation and what
33actions the school district will take or has taken to prevent
34future violations. The notice shall be in writing and
35personally delivered or mailed by certified mail.

   1(4)  Provide the department of education and board of
2educational examiners with notice of the violation.
   3d.  In the case of an administrator’s third or subsequent
4violation of paragraph “a”, the school district that employs the
5administrator shall do all of the following:
   6(1)  Provide the administrator with written notice of the
7violation. The notice shall be in writing and personally
8delivered or mailed by certified mail.
   9(2)  Suspend the administrator without pay for the remainder
10of the semester. However, if there are less than ninety days
11remaining in the semester, the school district shall suspend
12the administrator without pay for the remainder of the semester
13and for the first one quarter of the days in the subsequent
14semester.
   15(3)  Provide the parents and guardians of students enrolled
16in the school with written notice of the violation and what
17actions the school district will take or has taken to prevent
18future violations. The notice shall be in writing and
19personally delivered or mailed by certified mail.
   20(4)  Provide the department of education and board of
21educational examiners with notice of the violation.
22EXPLANATION
23The inclusion of this explanation does not constitute agreement with
24the explanation’s substance by the members of the general assembly.
   25This bill prohibits administrators from permitting the
26teaching of certain specified concepts in school districts.
   27The bill defines “administrator” as a person who is licensed
28to coordinate, supervise, or direct an educational program or
29the activities of other practitioners. The bill prohibits an
30administrator from permitting race or sex scapegoating, race
31or sex stereotyping, or specific defined concepts from being
32taught in any school that the administrator supervises or
33directs.
   34In the case of an administrator’s first violation of the
35bill’s provisions, the bill requires the school district to
-2-1provide the administrator with written notice of the violation,
2provide the parents and guardians of students enrolled in the
3school with written notice of the violation, and provide the
4department of education and board of educational examiners with
5notice of the violation. In the case of an administrator’s
6second violation of the bill’s provisions, the bill requires
7the school district to provide the administrator with written
8notice of the violation, suspend the administrator for
9one week without pay, provide the parents and guardians of
10students enrolled in the school with written notice of the
11violation, and provide the department and board with notice
12of the violation. The bill provides that, in the case of an
13administrator’s third or subsequent violation of the bill’s
14provisions, the school district that employs the administrator
15shall provide the administrator with written notice of the
16violation, suspend the administrator for the remainder of
17the semester without pay, and if there are less than 90 days
18remaining in the semester, suspend the administrator without
19pay for the remainder of the semester and for the first one
20quarter of the days in the subsequent semester, provide the
21parents and guardians of students enrolled in the school with
22written notice of the violation, and provide the department and
23board with notice of the violation.
