3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  602.1601A  Video and telephonic
2hearings in criminal proceedings.
   31.  Upon motion of any of the parties, an arraignment,
4pretrial conference, scheduling conference, or any other
5noncontested criminal proceeding shall be conducted by
6videoconference or telephone with the parties and other
7participants.
   82.  Upon motion of any of the parties, a hearing in a
9criminal case may be conducted by videoconference or telephone
10with the parties and other participants if the hearing is
11conducted in an efficient manner and the hearing does not
12prejudice a substantial right of either party.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill relates to video and telephonic hearings in
17criminal proceedings.
   18The bill provides that upon motion of any party, an
19arraignment, pretrial conference, scheduling conference, or
20any other noncontested criminal proceeding shall be conducted
21by videoconference or telephone with the parties and other
22participants. Upon motion of any party, a hearing in a
23criminal case may be conducted with the parties and other
24participants by videoconference or telephone when the hearing
25can be handled efficiently and a substantial right of a party
26is not prejudiced.
