3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 40.1, Code 2021, is amended by striking
2the section and inserting in lieu thereof the following:
   340.1  Congressional districts.
   4The state of Iowa is hereby organized and divided into four
5congressional districts, which shall be composed, respectively,
6of the following counties:
   71.  The first district shall consist of the counties of
8Cedar, Clinton, Des Moines, Henry, Iowa, Jackson, Jasper,
9Jefferson, Johnson, Jones, Keokuk, Lee, Louisa, Mahaska,
10Marion, Muscatine, Scott, Van Buren, Warren, and Washington.
   112.  The second district shall consist of the counties of
12Allamakee, Benton, Black Hawk, Bremer, Buchanan, Butler, Cerro
13Gordo, Chickasaw, Clayton, Delaware, Dubuque, Fayette, Floyd,
14Grundy, Hardin, Howard, Linn, Mitchell, Poweshiek, Tama,
15Winneshiek, and Worth.
   163.  The third district shall consist of the counties of
17Adair, Adams, Appanoose, Cass, Clarke, Dallas, Davis, Decatur,
18Greene, Guthrie, Lucas, Madison, Monroe, Montgomery, Page,
19Polk, Ringgold, Taylor, Union, Wapello, and Wayne.
   204.  The fourth district shall consist of the counties of
21Audubon, Boone, Buena Vista, Calhoun, Carroll, Cherokee, Clay,
22Crawford, Dickinson, Emmet, Franklin, Fremont, Hamilton,
23Hancock, Harrison, Humboldt, Ida, Kossuth, Lyon, Marshall,
24Mills, Monona, O’Brien, Osceola, Palo Alto, Plymouth,
25Pocahontas, Pottawattamie, Sac, Shelby, Sioux, Story, Webster,
26Winnebago, Woodbury, and Wright.
27   Sec. 2.  Section 41.1, Code 2021, is amended by striking the

9lying outside the corporate limits of the city of Sioux Center.
   104.  The fourth representative district shall consist of:

   165.  The fifth representative district shall consist of:

   236.  The sixth representative district shall consist of:

   2010.  The tenth representative district shall consist of:

   3016.  The sixteenth representative district shall consist of:

   25b.  Each odd-numbered senatorial district established by
26section 41.2 which the general assembly adopts by reference,
27and section 2 of this Act, shall elect a senator in 2022 for
28a four-year term commencing in January 2023. If an incumbent
29senator who was elected to a four-year term which commenced in
30January 2021, or was subsequently elected to fill a vacancy in
31such a term, is residing in an odd-numbered senatorial district
32on February 2, 2022, that senator’s term of office shall be
33terminated on January 1, 2023.
   34c.  Each even-numbered senatorial district established by
35section 41.2 which the general assembly adopts by reference,
-68-1and section 2 of this Act, shall elect a senator in 2024 for a
2four-year term commencing in January 2025.
   3(1)  If one and only one incumbent state senator is residing
4in an even-numbered senatorial district on February 2, 2022,
5and that senator meets all of the following requirements, the
6senator shall represent the district in the senate for the
7Ninetieth General Assembly:
   8(a)  The senator was elected to a four-year term which
9commenced in January 2021 or was subsequently elected to fill a
10vacancy in such a term.
   11(b)  The senatorial district in the plan which includes
12the place of residence of the state senator on the date of
13the senator’s last election to the senate is the same as the
14even-numbered senatorial district in which the senator resides
15on February 2, 2022, or is contiguous to such even-numbered
16senatorial district and the senator’s declared residence as
17of February 2, 2022, was within the district from which the
18senator was last elected. Areas which meet only at the points
19of adjoining corners are not contiguous.
   20(2)  Each even-numbered senatorial district to which
21subparagraph (1) of this paragraph “c” is not applicable
22shall elect a senator in 2022 for a two-year term commencing
23in January 2023. However, if more than one incumbent state
24senator is residing in an even-numbered senatorial district on
25February 2, 2022, and, on or before February 16, 2022, all but
26one of the incumbent senators resigns from office effective no
27later than January 1, 2023, the remaining incumbent senator
28shall represent the district in the senate for the Ninetieth
29General Assembly if that senator meets the requirements of
30subparagraph (1), subparagraph divisions (a) and (b) of this
31paragraph “c”. A copy of the resignation must be filed in the
32office of the secretary of state no later than 5:00 p.m.on
33February 16, 2022.
   34d.  To fulfill the purposes of this subsection, the secretary
35of state shall prescribe a form to be completed by all senators
-69-1to declare their residences as of February 2, 2022. The form
2shall be filed with the secretary of state no later than 5:00
3p.m.on February 2, 2022.
4   Sec. 4.  VACANCIES.
   51.  MEMBER OF CONGRESS.  If a special election to fill a
6vacancy for a representative in Congress occurs or exists
7after the effective date of this Act, at a time which makes
8it necessary to fill the vacancy at a special election held
9pursuant to section 69.14, the vacancy shall be filled from the
10same district provided in chapter 40, Code 2021, which elected
11the representative whose seat is vacant. This subsection does
12not apply if a special election is not required under section
1369.14.
   142.  MEMBER OF GENERAL ASSEMBLY.  If a vacancy in the
15Eighty-ninth General Assembly occurs or exists after the
16effective date of this Act, at a time which makes it necessary
17to fill the vacancy at a special election held pursuant to
18section 69.14, the vacancy shall be filled from the same
19district provided in chapter 41, Code 2021, which elected
20the senator or representative whose seat is vacant. This
21subsection does not apply if a special election is not required
22under section 69.14.
   233.  REPEAL.  This section is repealed January 1, 2023.
24   Sec. 5.  GEOGRAPHY.  For purposes of this Act, each reference
25to a specific city, township, street, or other boundary means
26such city, township, street, or other boundary as they are
27delineated and described in the 2020 topologically integrated
28geographic encoding and referencing system (TIGER) data file
29created by the United States census bureau that corresponds to
30the population data provided to the state under Pub.L. No.
3194-171 based upon the 2020 United States decennial census.
32   Sec. 6.  EFFECTIVE DATE.  This Act, being deemed of immediate
33importance, takes effect upon enactment.
34EXPLANATION
35The inclusion of this explanation does not constitute agreement with
-70-1the explanation’s substance by the members of the general assembly.
   2This bill establishes congressional and legislative
3districts for the state effective during the 2022 and
4subsequent general elections. Current Code section 41.2
5provides that state senate districts are composed of two
6state representative districts and specifies which numbered
7representative districts make up each numbered senate district.
8The bill takes effect upon enactment.
