2an out-of-state applicant or student to pay in-state tuition
3rates at a state university or community college if the
4individual agrees to live and work in Iowa for a specified
5time period following graduation.
6BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 260C.14, subsection 2, Code 2021, is
2amended to read as follows:
   32.  Have authority to determine tuition rates for
4instruction.
   5a.  Tuition for residents of Iowa shall not exceed the
6lowest tuition rate per semester, or the equivalent, charged
7by an institution of higher education under the state board of
8regents for a full-time resident student. However, except
   9b.   Exceptfor students enrolled under section 261E.6, if
10a local school district pays tuition for a resident pupil of
11high school age, the limitation on tuition for residents of
12Iowa shall not apply, the amount of tuition shall be determined
13by the board of directors of the community college with the
14consent of the local school board, and the pupil shall not
15be included in the full-time equivalent enrollment of the
16community college for the purpose of computing general aid to
17the community college.
   18c.  Tuition for nonresidents of Iowa shall not be less than
19the marginal cost of instruction of a student attending the
20college. A lower tuition for nonresidents may be permitted
21under a reciprocal tuition agreement between a merged area and
22an educational institution in another state, if the agreement
23is approved by the director. The board may designate that a
24portion of the tuition moneys collected from students be used
25for student aid purposes.
   26d.  Subject to an appropriation of funds by the general
27assembly for this purpose, and notwithstanding paragraph “c”,
28the board shall develop and implement a program to classify
29nonresidents as residents for purposes of tuition and mandatory
30fees if the nonresident applicant or student agrees to live
31and work in this state following graduation from the community
32college for an amount of time equivalent to the amount of time
33the individual paid in-state tuition and mandatory fee rates.
34   Sec. 2.  Section 262.9, subsection 17, Code 2021, is amended
35by adding the following new paragraph:
-1-1   NEW PARAGRAPH.  c.  Subject to an appropriation of funds by
2the general assembly for this purpose, develop and implement
3a program to classify nonresidents as residents for purposes
4of undergraduate tuition and mandatory fees if the nonresident
5applicant or student agrees to live and work in this state
6following graduation from the institution for an amount of time
7equivalent to the amount of time the individual paid in-state
8undergraduate tuition and mandatory fee rates.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill requires the board of directors of each community
13college and the state board of regents to develop and
14implement a program to classify nonresidents as residents
15for undergraduate tuition and mandatory fees purposes if the
16nonresident applicant or student agrees to live and work
17in this state following graduation for an amount of time
18equivalent to the amount of time the individual paid in-state
19tuition and mandatory fee rates.
