7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2rebuild iowa infrastructure fund
3   Section 1.  REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS.
  There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the following fiscal years, the following amounts, or so
7much thereof as is necessary, to be used for the purposes
8designated:
   91.  DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
   10a.  (1)  For deposit in the water quality initiative fund
11created in section 466B.45 for purposes of supporting the
12water quality initiative administered by the division of soil
13conservation and water quality as provided in section 466B.42,
14including salaries, support, maintenance, and miscellaneous
15purposes, notwithstanding section 8.57, subsection 5, paragraph
16“c”:
   17FY 2021-2022:

   19(2)  (a)  The moneys appropriated in this lettered
20paragraph shall be used to support demonstration projects in
21subwatersheds as designated by the department that are part
22of high-priority watersheds identified by the water resources
23coordinating council.
   24(b)  The moneys appropriated in this lettered paragraph
25shall be used to support demonstration projects in watersheds
26generally, including regional watersheds, as designated by the
27division and high-priority watersheds identified by the water
28resources coordinating council.
   29(3)  In supporting projects in watersheds and subwatersheds
30as provided in subparagraph (2), all of the following shall
31apply:
   32(a)  The demonstration projects shall utilize water quality
33practices as described in the latest revision of the document
34entitled “Iowa Nutrient Reduction Strategy” initially presented
35in November 2012 by the department of agriculture and land
-1-1stewardship, the department of natural resources, and Iowa
2state university of science and technology.
   3(b)  The division shall implement demonstration projects
4as provided in subparagraph division (a) by providing
5for participation by persons who hold a legal interest in
6agricultural land used in farming. To every extent practical,
7the division shall provide for collaborative participation by
8such persons who hold a legal interest in agricultural land
9located within the same subwatershed.
   10(c)  The division shall implement demonstration projects on
11a cost-share basis as determined by the division. Except for
12edge-of-field practices, the state’s share of the amount shall
13not exceed 50 percent of the estimated cost of establishing the
14practice as determined by the division or 50 percent of the
15actual cost of establishing the practice, whichever is less.
   16(d)  The demonstration projects shall be used to educate
17other persons about the feasibility and value of establishing
18similar water quality practices. The division shall promote
19field day events for purposes of allowing interested persons to
20establish water quality practices on their agricultural land.
   21(e)  The division shall conduct water quality evaluations
22within supported subwatersheds. Within a reasonable period
23after accumulating information from such evaluations, the
24division shall create an aggregated database of water quality
25practices. Any information identifying a person holding a
26legal interest in agricultural land or specific agricultural
27land shall be a confidential record.
   28(4)  The moneys appropriated in this lettered paragraph
29shall be used to support education and outreach in a manner
30that encourages persons who hold a legal interest in
31agricultural land used for farming to implement water quality
32practices, including the establishment of such practices in
33watersheds generally, and not limited to subwatersheds or
34high-priority watersheds.
   35(5)  The moneys appropriated in this lettered paragraph
-2-1may be used to contract with persons to coordinate the
2implementation of efforts provided in this paragraph.
   3(6)  The moneys appropriated in this lettered paragraph
4may be used by the department to support urban soil and water
5conservation efforts, which may include but are not limited
6to management practices related to bioretention, landscaping,
7the use of permeable or pervious pavement, and soil quality
8restoration. The moneys shall be allocated on a cost-share
9basis as provided in chapter 161A.
   10(7)  Notwithstanding any other provision of law to the
11contrary, the department may use moneys appropriated in
12this lettered paragraph to carry out the provisions of this
13paragraph on a cost-share basis in combination with other
14moneys available to the department from a state or federal
15source.
   16(8)  Not more than 10 percent of the moneys appropriated in
17this lettered paragraph may be used for costs of administration
18and implementation of the water quality initiative administered
19by the soil conservation division.
   20b.  For deposit in the renewable fuels infrastructure fund
21created in section 159A.16 for renewable fuel infrastructure
22programs:

27miscellaneous provisions
28   Sec. 12.  Section 8.57C, subsection 3, Code 2021, is amended
29by adding the following new paragraph:
30   NEW PARAGRAPH.  j.  There is appropriated from the rebuild
31Iowa infrastructure fund for the fiscal year beginning July 1,
322021, and ending June 30, 2022, the sum of seventeen million
33five hundred thousand dollars to the technology reinvestment
34fund, notwithstanding section 8.57, subsection 5, paragraph
35“c”.

1   Sec. 13.  Section 15.261, Code 2021, is amended to read as
2follows:
   315.261  Vacant state buildings demolition fund.
   41.  A vacant state buildings demolition fund is created in
5the state treasury under the control of the authority. The
6fund shall consist of all moneys appropriated to the fund.
   72.  Moneys in the vacant state buildings demolition fund
8are appropriated to the authority for purposes of funding a
9grant program for the demolition of vacant buildings owned by
10the state or by a county that has purchased real property from
11the federal government
which are no longer used for a state
 12or federal purpose. The authority shall give preference to
13applicants that have not previously been awarded money from
14this fund.

   153.  Notwithstanding section 12C.7, subsection 2, interest
16or earnings on moneys deposited in the vacant state buildings
17demolition fund shall be credited to the vacant state buildings
18demolition fund. Notwithstanding section 8.33, moneys credited
19to the vacant state buildings demolition fund shall not revert
20at the close of a fiscal year.
21   Sec. 14.  Section 15.262, Code 2021, is amended to read as
22follows:
   2315.262  Vacant state buildings rehabilitation fund.
   241.  A vacant state buildings rehabilitation fund is created
25in the state treasury under the control of the authority. The
26fund shall consist of all moneys appropriated to the fund.
   272.  Moneys in the vacant state buildings rehabilitation fund
28are appropriated to the authority for purposes of funding a
29loan program for the rehabilitation or redevelopment of vacant
30buildings owned by the state or by a county that has purchased
31real property from the federal government
which are no longer
32used for a state or federal purpose. The authority shall give
33preference to applicants that have not previously been awarded
34money from this fund.

   353.  Notwithstanding section 12C.7, subsection 2, interest
-16-1or earnings on moneys deposited in the vacant state buildings
2rehabilitation fund shall be credited to the vacant state
3 buildings rehabilitation fund. Notwithstanding section 8.33,
4moneys credited to the vacant state buildings rehabilitation
5fund shall not revert at the close of a fiscal year.
6   Sec. 15.  ROUTINE MAINTENANCE FUND.  Notwithstanding the
7standing appropriation in section 8A.330, there is appropriated
8from the rebuild Iowa infrastructure fund to the department of
9administrative services for deposit in the routine maintenance
10fund established in section 8A.330 for the fiscal year
11beginning July 1, 2021, the sum of one million dollars.
12DIVISION V
13autism support fund
14   Sec. 16.  AUTISM SUPPORT FUND — APPROPRIATION.  There is
15appropriated from the autism support fund created in section
16225D.2 to the rebuild Iowa infrastructure fund created in
17section 8.57, for the fiscal year beginning July 1, 2021, and
18ending June 30, 2022, the sum of seven hundred fifty thousand
19dollars, notwithstanding any provision of section 225D.2 to the
20contrary.
21DIVISION VI
22sports tourism program
23   Sec. 17.  Section 15F.401, subsection 1, paragraph a, Code
242021, is amended to read as follows:
   25a.  The authority shall establish, and, at the direction of
26the board, shall administer a sports tourism program to provide
27financial assistance for projects that promote sporting events
28for organizations of accredited colleges and universities,
29professional sporting events,
and other sporting events in the
30state.
31   Sec. 18.  Section 15F.401, subsection 1, paragraph b,
32subparagraph (3), Code 2021, is amended to read as follows:
   33(3)  “Organization” means a corporation, conference,
34association, or other organization which has as one of
35its primary purposes the sponsoring or administration
-17-1of extracurricular intercollegiate athletic contests or
2competitions, or professional sporting events.
3   Sec. 19.  Section 15F.401, subsection 1, paragraph b, Code
42021, is amended by adding the following new subparagraph:
5   NEW SUBPARAGRAPH.  (4)  “Professional sporting events” means
6any sporting events for which the competing athletes receive
7payment for their participation in such sporting event.
8   Sec. 20.  Section 15F.401, subsection 2, paragraph a, Code
92021, is amended to read as follows:
   10a.  A city or county in the state or a public entity,
11including a convention and visitors bureau or a district,
12may apply to the authority for financial assistance for a
13project that actively and directly promotes sporting events for
14accredited colleges and universities, professional sporting
15events,
and other sporting events in the area served by the
16city, county, or public entity.
17   Sec. 21.  SPORTS TOURISM PROGRAM — SPORTS WAGERING RECEIPTS
18FUND.
  There is appropriated from the sports wagering receipts
19fund created in section 8.57, subsection 6, to the economic
20development authority for the fiscal year beginning July 1,
212021, and ending June 30, 2022, the following amount, or so
22much thereof as is necessary, to be used for the purposes
23designated:

26EXPLANATION
27The inclusion of this explanation does not constitute agreement with
28the explanation’s substance by the members of the general assembly.
   29This bill relates to and makes appropriations to state
30departments and agencies from the rebuild Iowa infrastructure
31fund and the technology reinvestment fund, and provides for
32related matters. The bill is organized by divisions.
   33DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
34division appropriates project funding for FY 2021-2022
35from the rebuild Iowa infrastructure fund for projects
-18-1for the departments of agriculture and land stewardship,
2blind, cultural affairs, human services, public safety,
3transportation, and veterans affairs, and for the economic
4development authority, board of regents, and treasurer of
5state. The division also appropriates project funding from
6the rebuild Iowa infrastructure fund for multiple fiscal years
7to the departments of corrections, public defense, and natural
8resources.
   9DIVISION II — TECHNOLOGY REINVESTMENT FUND. This
10division appropriates project funding for FY 2021-2022
11from the technology reinvestment fund for the departments
12of corrections, education, homeland security and emergency
13management, human rights, human services, inspections and
14appeals, management, public defense, public safety, revenue,
15and veterans affairs, and for the judicial branch, the office
16of the chief information officer, and for the ethics and
17campaign disclosure board.
   18DIVISION III — CHANGES TO PRIOR APPROPRIATIONS. This
19division makes a change to moneys appropriated from the rebuild
20Iowa infrastructure fund to the department of administrative
21services for major maintenance projects, the economic
22development authority for the vacant state buildings demolition
23and rehabilitation funds, the board of regents for projects
24at the Iowa state university of science and technology, and
25the judicial branch for furniture and equipment at certain
26justice centers. The division also makes a change to the
27reversion provision for moneys appropriated from the rebuild
28Iowa infrastructure fund to the department of cultural affairs
29for maintenance projects for the state historical building in
30FY 2017-2018. The division takes effect upon enactment.
   31DIVISION IV — MISCELLANEOUS PROVISIONS. Code section
328.57C, concerning the technology reinvestment fund, is amended
33to provide for an appropriation to the fund from the rebuild
34Iowa infrastructure fund for the fiscal year beginning July 1,
352021, of $17.5 million.

   1Code section 15.261, concerning the vacant state buildings
2demolition fund, is amended to allow moneys in the fund to be
3used for demolition of vacant buildings purchased by a county
4from the federal government. The Code section is also amended
5to give preference to applicants who have not previously been
6awarded money from the fund.
   7Code section 15.262, concerning the vacant state buildings
8rehabilitation fund, is amended to allow moneys in the fund
9to be used for rehabilitation of vacant buildings purchased
10by a county from the federal government. The Code section is
11also amended to give preference to applicants who have not
12previously been awarded money from the fund.
   13The bill reduces the standing appropriation from the rebuild
14Iowa infrastructure fund to the routine maintenance fund
15created in Code section 8A.330 for the fiscal year beginning
16July 1, 2021, from $2 million to $1 million.
   17DIVISION V — AUTISM SUPPORT FUND. This division
18appropriates moneys from the autism support fund to the rebuild
19Iowa infrastructure fund for FY 2021-2022.
   20DIVISION VI — SPORTS TOURISM PROGRAM. Code section
2115F.401, creating the sports tourism program, is amended to
22provide that the program is authorized to provide financial
23assistance for projects that promote professional sporting
24events. The bill further appropriates moneys to the economic
25development authority for the sports tourism program for FY
262021-2022 from the sports wagering receipts fund created in
27Code section 8.57, subsection 6.
