3APPROPRIATIONS
4 Section 1. DEPARTMENT OF CULTURAL AFFAIRS.
51. There is appropriated from the general fund of the state
6to the department of cultural affairs for the fiscal year
7beginning July 1, 2021, and ending June 30, 2022, the following
8amounts, or so much thereof as is necessary, to be used for the
9purposes designated:
10a. ADMINISTRATION
11For salaries, support, maintenance, and miscellaneous
12purposes, and for not more than the following full-time
13equivalent positions for the department:

16The department of cultural affairs shall coordinate
17activities with the tourism office of the economic development
18authority to promote attendance at the state historical
19building and at the state’s historic sites.

23“g”.
24b. COMMUNITY CULTURAL GRANTS

142. Notwithstanding section 8.33, moneys appropriated in
15this section that remain unencumbered or unobligated at the
16close of the fiscal year shall not revert but shall remain
17available for expenditure for the purposes designated until the
18close of the succeeding fiscal year.
19 Sec. 2. GOALS AND ACCOUNTABILITY — ECONOMIC DEVELOPMENT.
201. For the fiscal year beginning July 1, 2021, the goals
21for the economic development authority shall be to expand and
22stimulate the state economy, increase the wealth of Iowans, and
23increase the population of the state.
242. To achieve the goals in subsection 1, the economic
25development authority shall do all of the following for the
26fiscal year beginning July 1, 2021:
27a. Concentrate its efforts on programs and activities that
28result in commercially viable products and services.
29b. Adopt practices and services consistent with free
30market, private sector philosophies.
31c. Ensure economic growth and development throughout the
32state.
33d. Work with businesses and communities to continually
34improve the economic development climate along with the
35economic well-being and quality of life for Iowans.
-2- 1e. Coordinate with other state agencies to ensure that they
2are attentive to the needs of an entrepreneurial culture.
3f. Establish a strong and aggressive marketing image to
4showcase Iowa’s workforce, existing industry, and potential.
5A priority shall be placed on recruiting new businesses,
6business expansion, and retaining existing Iowa businesses.
7Emphasis shall be placed on entrepreneurial development through
8helping entrepreneurs secure capital, and developing networks
9and a business climate conducive to entrepreneurs and small
10businesses.
11g. Encourage the development of communities and quality of
12life to foster economic growth.
13h. Prepare communities for future growth and development
14through development, expansion, and modernization of
15infrastructure.
16i. Develop public-private partnerships with Iowa businesses
17in the tourism industry, Iowa tour groups, Iowa tourism
18organizations, and political subdivisions in this state to
19assist in the development of advertising efforts.
20j. Develop, to the fullest extent possible, cooperative
21efforts for advertising with contributions from other sources.
22 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY.
231. APPROPRIATION
24a. There is appropriated from the general fund of the state
25to the economic development authority for the fiscal year
26beginning July 1, 2021, and ending June 30, 2022, the following
27amount, or so much thereof as is necessary, to be used for the
28purposes designated in this subsection, and for not more than
29the following full-time equivalent positions:

32b. (1) For salaries, support, miscellaneous purposes,
33programs, marketing, and the maintenance of an administration
34division, a business development division, a community
35development division, a small business development division,
-3-1and other divisions the authority may organize.
2(2) The full-time equivalent positions authorized under
3this section are funded, in whole or in part, by the moneys
4appropriated under this subsection or by other moneys received
5by the authority, including certain federal moneys.
6(3) For business development operations and programs,
7international trade, export assistance, workforce recruitment,
8and the partner state program.
9(4) For transfer to a fund created pursuant to section
1015.313 for purposes of financing strategic infrastructure
11projects.
12(5) For community economic development programs, tourism
13operations, community assistance, plans for Iowa green corps
14and summer youth programs, the main street and rural main
15street programs, the school-to-career program, the community
16development block grant, and housing and shelter-related
17programs.
18(6) For achieving the goals and accountability, and
19fulfilling the requirements and duties required under this Act.
20c. Notwithstanding section 8.33, moneys appropriated in
21this subsection that remain unencumbered or unobligated at the
22close of the fiscal year shall not revert but shall remain
23available for expenditure for the purposes designated in this
24subsection until the close of the succeeding fiscal year.
252. FINANCIAL ASSISTANCE RESTRICTIONS
26a. A business creating jobs through moneys appropriated in
27subsection 1 shall be subject to contract provisions requiring
28new and retained jobs to be filled by individuals who are
29citizens of the United States who reside within the United
30States, or any person authorized to work in the United States
31pursuant to federal law, including legal resident aliens
32residing in the United States.
33b. Any vendor who receives moneys appropriated in
34subsection 1 shall adhere to such contract provisions and
35provide periodic assurances as the state shall require that the
-4-1jobs are filled solely by citizens of the United States who
2reside within the United States, or any person authorized to
3work in the United States, pursuant to federal law, including
4legal resident aliens residing in the United States.
5c. A business that receives financial assistance from
6the authority from moneys appropriated in subsection 1 shall
7only employ individuals legally authorized to work in this
8state. In addition to all other applicable penalties provided
9by current law, all or a portion of the assistance received
10by a business which is found to knowingly employ individuals
11not legally authorized to work in this state is subject to
12recapture by the authority.
133. USES OF APPROPRIATIONS
14a. From the moneys appropriated in subsection 1, the
15authority may provide financial assistance in the form of a
16grant to a community economic development entity for conducting
17a local workforce recruitment effort designed to recruit former
18citizens of the state and former students at colleges and
19universities in the state to meet the needs of local employers.
20b. From the moneys appropriated in subsection 1, the
21authority may provide financial assistance to early stage
22industry companies being established by women entrepreneurs.
23c. From the moneys appropriated in subsection 1, the
24authority may provide financial assistance in the form of
25grants, loans, or forgivable loans for advanced research and
26commercialization projects involving value-added agriculture,
27advanced technology, or biotechnology.
28d. The authority shall not use any moneys appropriated in
29subsection 1 for purposes of providing financial assistance for
30the Iowa green streets pilot project or for any other program
31or project that involves the installation of geothermal systems
32for melting snow and ice from streets or sidewalks.
334.WORLD FOOD PRIZE
34In lieu of the standing appropriation in section 15.368,
35there is appropriated from the general fund of the state to the
-5-1economic development authority for the fiscal year beginning
2July 1, 2021, and ending June 30, 2022, the following amount
3for the world food prize:

55. IOWA COMMISSION ON VOLUNTEER SERVICE
6a. There is appropriated from the general fund of the state
7to the economic development authority for the fiscal year
8beginning July 1, 2021, and ending June 30, 2022, the following
9amount for allocation to the Iowa commission on volunteer
10service for purposes of the Iowa state commission grant
11program, the Iowa’s promise and Iowa mentoring partnership
12programs, and for not more than the following full-time
13equivalent positions:

16Of the moneys appropriated in this subsection, the
17authority shall allocate $75,000 for purposes of the Iowa state
18commission grant program and $93,201 for purposes of the Iowa’s

21this subsection that remain unencumbered or unobligated at the

256. COUNCILS OF GOVERNMENTS — ASSISTANCE
26There is appropriated from the general fund of the state
27to the economic development authority for the fiscal year
28beginning July 1, 2021, and ending June 30, 2022, the following
29amount to be used for the purposes of providing financial
30assistance to Iowa’s councils of governments:

327. FUTURE READY IOWA REGISTERED APPRENTICESHIP DEVELOPMENT
33PROGRAM
34a. There is appropriated from the general fund of the state
35to the economic development authority for the fiscal year

2amount to be used for the funding of the future ready Iowa
3registered apprenticeship development program under chapter
415C, to encourage small to midsize businesses to start or grow
5registered apprenticeships:

128. SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS
13INTERNSHIPS
14a. There is appropriated from the Iowa skilled worker and
15job creation fund created in section 8.75 to the Iowa economic
16development authority for the fiscal year beginning July 1,
172021, and ending June 30, 2022, the following amount, or so
18much thereof as is necessary, to be used for the purposes
19designated:
20For the funding of internships for students studying in the
21fields of science, technology, engineering, and mathematics
22with eligible Iowa employers as provided in section 15.411,
23subsection 3, paragraph “c”:

25b. No more than 3 percent of the moneys appropriated in this
26subsection may be used by the authority for costs associated
27with administration of the internship program.
28c. Notwithstanding section 8.33, moneys appropriated in

31available for expenditure for the purposes designated in
32subsequent fiscal years.
339. FUTURE READY IOWA — VOLUNTEER MENTORING PROGRAM
34a. There is appropriated from the Iowa skilled worker and
35job creation fund created in section 8.75 to the economic

22021, and ending June 30, 2022, the following amount, or so
3much thereof as is necessary, to be used for the purpose
4designated:
5For allocation to the Iowa commission on volunteer services
6to be used for establishing a volunteer mentor program to
7support implementation of the future ready Iowa skilled
8workforce last-dollar scholarship program in section 261.131
9and the future ready Iowa skilled workforce grant program
10created in section 261.132, and for not more than the following
11full-time equivalent positions:

232021, and ending June 30, 2022, the following amounts, or so
24much thereof as is necessary, for the purposes designated:

29b. Notwithstanding section 8.33, moneys appropriated in
30this subsection which remain unencumbered or unobligated at

34c. The authority shall adopt rules pursuant to chapter
3517A to establish criteria for the distribution of the moneys

2 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS — FY
32021-2022. Notwithstanding the standing appropriations
4in the following designated sections for the fiscal year
5beginning July 1, 2021, and ending June 30, 2022, the amounts
6appropriated from the general fund of the state pursuant to
7these sections for the following purposes shall not exceed the
8following amounts:
91. For operational support grants and community cultural
10grants under section 99F.11, subsection 3, paragraph “d”,
11subparagraph (1):

132. For the purposes of regional tourism marketing under
14section 99F.11, subsection 3, paragraph “d”, subparagraph (2):

16 Sec. 5. FINANCIAL ASSISTANCE REPORTING — ECONOMIC
17DEVELOPMENT AUTHORITY. The economic development authority and
18the department of revenue shall submit a joint annual report
19to the general assembly no later than November 1, 2021, that
20details the amount of every direct loan, forgivable loan,
21tax credit, tax exemption, tax refund, grant, or any other
22financial assistance awarded to a person during the prior
23fiscal year by the authority under an economic development
24program administered by the authority. The report shall
25identify the county where the project associated with each such
26award is located.
27 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the
28moneys collected by the insurance division in excess of the
29anticipated gross revenues under section 505.7, subsection
303, during the fiscal year beginning July 1, 2021, $100,000
31shall be transferred to the economic development authority for
32insurance economic development and international insurance
33economic development.
34 Sec. 7. IOWA FINANCE AUTHORITY.
351. There is appropriated from the general fund of the state
-9-1to the Iowa finance authority for the fiscal year beginning
2July 1, 2021, and ending June 30, 2022, the following amount,
3or so much thereof as is necessary, to be used to provide
4reimbursement for rent expenses to eligible persons under
5the home and community-based services rent subsidy program
6established in section 16.55:

82. Of the moneys appropriated in this section, not more than
9$35,000 may be used for administrative costs.
103. Notwithstanding section 8.33, moneys appropriated in
11this section that remain unencumbered or unobligated at the
12close of the fiscal year shall not revert but shall remain
13available for expenditure for the purposes designated until the
14close of the succeeding fiscal year.
15 Sec. 8. IOWA FINANCE AUTHORITY AUDIT. The auditor of state
16is requested to review the audit of the Iowa finance authority
17performed by the auditor hired by the authority.
18 Sec. 9. PUBLIC EMPLOYMENT RELATIONS BOARD.
191. There is appropriated from the general fund of the state
20to the public employment relations board for the fiscal year
21beginning July 1, 2021, and ending June 30, 2022, the following
22amount, or so much thereof as is necessary, to be used for the
23purposes designated:
24For salaries, support, maintenance, and miscellaneous
25purposes, and for not more than the following full-time
26equivalent positions:

292. Of the moneys appropriated in this section, the board
30shall allocate $15,000 for maintaining an internet site that
31allows access to a searchable database of collective bargaining
32information.
33 Sec. 10. DEPARTMENT OF WORKFORCE DEVELOPMENT. There
34is appropriated from the general fund of the state to the
35department of workforce development for the fiscal year
-10-1beginning July 1, 2021, and ending June 30, 2022, the following
2amounts, or so much thereof as is necessary, to be used for the
3purposes designated:
41. DIVISION OF LABOR SERVICES
5a. For the division of labor services, including salaries,
6support, maintenance, and miscellaneous purposes, and for not
7more than the following full-time equivalent positions:

10b. From the contractor registration fees, the division of
11labor services shall reimburse the department of inspections
12and appeals for all costs associated with hearings under
13chapter 91C, relating to contractor registration.
142. DIVISION OF WORKERS’ COMPENSATION
15a. For the division of workers’ compensation, including
16salaries, support, maintenance, and miscellaneous purposes, and
17for not more than the following full-time equivalent positions:

20b. The division of workers’ compensation shall charge a
21$100 filing fee for workers’ compensation cases. The filing
22fee shall be paid by the petitioner of a claim. However, the
23fee can be taxed as a cost and paid by the losing party, except
24in cases where it would impose an undue hardship or be unjust
25under the circumstances. The moneys generated by the filing
26fee allowed under this subsection are appropriated to the
27department of workforce development to be used for purposes of
28administering the division of workers’ compensation.
293. WORKFORCE DEVELOPMENT OPERATIONS
30a. For the operation of field offices, the workforce
31development board, and for not more than the following
32full-time equivalent positions:

6a. For the development and administration of an offender
7reentry program to provide offenders with employment skills,
8and for not more than the following full-time equivalent

2 Sec. 11. GENERAL FUND — EMPLOYEE MISCLASSIFICATION
3PROGRAM. There is appropriated from the general fund of the
4state to the department of workforce development for the fiscal
5year beginning July 1, 2021, and ending June 30, 2022, the
6following amount, or so much thereof as is necessary, to be
7used for the purposes designated:
8For enhancing efforts to investigate employers that
9misclassify workers and for not more than the following
10full-time equivalent positions:

13 Sec. 12. SPECIAL EMPLOYMENT SECURITY CONTINGENCY FUND.
141. There is appropriated from the special employment
15security contingency fund to the department of workforce
16development for the fiscal year beginning July 1, 2021, and
17ending June 30, 2022, the following amount, or so much thereof
18as is necessary, to be used for field offices:

202. Any remaining additional penalty and interest revenue
21collected by the department of workforce development is
22appropriated to the department for the fiscal year beginning

25 Sec. 13. FUTURE READY IOWA — IOWA EMPLOYER INNOVATION FUND.
261. There is appropriated from the general fund of the state
27to the department of workforce development for the fiscal year
28beginning July 1, 2021, and ending June 30, 2022, the following
29amount, or so much thereof as is necessary, to be used for the
30purposes designated:
31In consultation with the workforce development board, for
32funding of the Iowa employer innovation program which shall
33match eligible employer moneys to expand opportunities for
34education and training leading to high-demand jobs and to
35encourage Iowa employers, community leaders, and others to
-13-1provide leadership and support for regional workforce talent
2pools throughout the state, and for future ready Iowa education
3and outreach:

5Of the moneys appropriated in this subsection, an amount
6to be determined by the department of workforce development
7in consultation with the workforce development board shall be
8transferred to the Iowa child care challenge fund.
92. Notwithstanding section 8.33, moneys appropriated in
10this section which remain unencumbered or unobligated at the
11end of the fiscal year shall not revert but shall remain
12available for expenditure for the purposes designated until the
13close of the succeeding fiscal year.
14 Sec. 14. UNEMPLOYMENT COMPENSATION RESERVE FUND —
15FIELD OFFICES. Notwithstanding section 96.9, subsection 8,
16paragraph “e”, there is appropriated from interest earned on
17the unemployment compensation reserve fund to the department
18of workforce development for the fiscal year beginning July
191, 2021, and ending June 30, 2022, the following amount, or
20so much thereof as is necessary, to be used for the purposes
21designated:
22For the operation of field offices:

24 Sec. 15. VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES. The
25department of workforce development shall require a unique
26identification login for all users of workforce development
27centers operated through electronic means.
28 Sec. 16. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding
29section 96.9, subsection 4, paragraph “a”, moneys credited to
30the state by the secretary of the treasury of the United
31States pursuant to section 903 of the Social Security
32Act are appropriated to the department of workforce
33development and shall be used by the department for the
34administration of the unemployment compensation program only.
35This appropriation shall not apply to any fiscal year
-14-1beginning after December 31, 2021.
2 Sec. 17. IOWA SKILLED WORKER AND JOB CREATION FUND.
31. There is appropriated from the Iowa skilled worker and
4job creation fund created in section 8.75 to the following
5departments, agencies, and institutions for the fiscal year
6beginning July 1, 2021, and ending June 30, 2022, the following
7amounts, or so much thereof as is necessary, to be used for the
8purposes designated:
9a. ECONOMIC DEVELOPMENT AUTHORITY
10(1) For the purposes of providing assistance as described in
11section 15.335B for the high quality jobs program:

13From the moneys appropriated in this subparagraph, the
14economic development authority may use not more than $1,000,000
15for purposes of providing infrastructure grants to main street
16communities under the main street Iowa program and may allocate
17not more than $300,000 for the purposes of supporting statewide
18worker education and quality preapprenticeship programs.
19(2) As a condition of receiving moneys appropriated in
20this lettered paragraph “a”, an entity shall testify upon the
21request of the joint appropriations subcommittee on economic
22development regarding the expenditure of such moneys.
23b. STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
24(1) STATE BOARD OF REGENTS. For capacity building
25infrastructure in areas related to technology
26commercialization, marketing and business development
27efforts in areas related to technology commercialization,
28entrepreneurship, and business growth, and infrastructure
29projects and programs needed to assist in implementation of
30activities under chapter 262B:

32(a) Of the moneys appropriated pursuant to this
33subparagraph (1), 35 percent shall be allocated for Iowa state
34university of science and technology, 35 percent shall be
35allocated for the state university of Iowa, and 30 percent
-15-1shall be allocated for the university of northern Iowa.
2(b) The institutions shall provide a one-to-one match
3of additional moneys for the activities funded with moneys
4appropriated under this subparagraph (1).
5(c) The state board of regents shall submit a report by
6January 15, 2022, to the governor and the general assembly
7regarding the activities, projects, and programs funded with
8moneys appropriated under this subparagraph (1). The report
9shall be provided in an electronic format and shall include a
10list of metrics and criteria mutually agreed to in advance by
11the board of regents and the economic development authority.
12The metrics and criteria shall allow the governor’s office and
13the general assembly to quantify and evaluate the progress
14of the board of regents institutions with regard to their
15activities, projects, and programs in the areas of technology
16commercialization, entrepreneurship, regional development, and
17market research.
18(2) IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
19small business development centers, the research park, and the
20center for industrial research and service, and for not more
21than the following full-time equivalent positions:

24(a) Of the moneys appropriated in this subparagraph (2),
25Iowa state university of science and technology shall allocate
26at least $735,728 for purposes of funding small business
27development centers. Iowa state university of science and
28technology may allocate the appropriated moneys to the various
29small business development centers in any manner necessary to
30achieve the purposes of this subparagraph.
31(b) Iowa state university of science and technology shall

2(c) It is the intent of the general assembly that the
3industrial incentive program focus on Iowa industrial sectors
4and seek contributions and in-kind donations from businesses,
5industrial foundations, and trade associations, and that moneys
6for the center for industrial research and service industrial
7incentive program shall be allocated only for projects which
8are matched by private sector moneys for directed contract
9research or for nondirected research. The match required of
10small businesses as defined in section 15.102, subsection 10,
11for directed contract research or for nondirected research
12shall be $1 for each $3 of state funds. The match required
13for other businesses for directed contract research or
14for nondirected research shall be $1 for each $1 of state
15funds. The match required of industrial foundations or trade
16associations shall be $1 for each $1 of state funds.
17(d) Iowa state university of science and technology shall
18report annually to the general assembly the total amount of
19private contributions, the proportion of contributions from
20small businesses and other businesses, and the proportion for
21directed contract research and nondirected research of benefit
22to Iowa businesses and industrial sectors.

24Iowa research park and for university of Iowa pharmaceuticals
25located at the research park, including salaries, support,

22BEER AND LIQUOR CONTROL FUND — TOURISM
23 Sec. 19. Section 123.17, Code 2021, is amended by adding the
24following new subsection:
25 NEW SUBSECTION. 6A. a. After any transfers provided for in
26subsections 3, 5, and 6, and before any other transfer to the
27general fund, the department of commerce shall transfer to the
28economic development authority from the beer and liquor control
29fund one million dollars annually for a statewide tourism
30marketing campaign.
31b. As part of the statewide tourism marketing campaign
32pursuant to paragraph “a”, the economic development authority
33shall issue a single request for proposals to select an entity
34located in this state for a statewide effort to leverage public
35and private partnerships to market and promote the state as a

2EXPLANATION
3The inclusion of this explanation does not constitute agreement with
4the explanation’s substance by the members of the general assembly.
5DIVISION I — FY 2021-2022 APPROPRIATIONS. This bill
6appropriates moneys for the fiscal year 2021-2022 from the
7general fund of the state to the department of cultural
8affairs, the economic development authority, the Iowa
9finance authority, the public employment relations board, the
10department of workforce development, Iowa state university of
11science and technology, the state university of Iowa, and the
12university of northern Iowa.
13The bill appropriates moneys for the fiscal year 2021-2022
14from the Iowa skilled worker and job creation fund created in
15Code section 8.75 to the economic development authority, the
16department of workforce development, and the state board of
17regents and institutions under the control of the board.
18For the fiscal year 2021-2022, the bill limits standing
19appropriations established in the Code for the world food
20prize, certain operational support grants, community cultural
21grants, and regional tourism marketing.
22The bill transfers $100,000 of the moneys collected by the
23insurance division in excess of the anticipated gross revenues
24under Code section 505.7 to the economic development authority.
25The bill appropriates moneys for the fiscal year 2021-2022
26from the special employment security contingency fund to the
27department of workforce development.
28The bill appropriates interest earned on the unemployment
29compensation reserve fund for the fiscal year 2021-2022 to the
30department of workforce development.
31Moneys credited to the state by the secretary of treasury
32of the United States pursuant to section 903 of the Social
33Security Act are appropriated to the department of workforce
34development.
35The auditor of state is requested to review the audit of the

3The bill requires the economic development authority and the

19 Sec. 2. GOALS AND ACCOUNTABILITY — ECONOMIC DEVELOPMENT.
201. For the fiscal year beginning July 1, 2021, the goals
21for the economic development authority shall be to expand and
22stimulate the state economy, increase the wealth of Iowans, and
23increase the population of the state.
242. To achieve the goals in subsection 1, the economic
25development authority shall do all of the following for the
26fiscal year beginning July 1, 2021:
27a. Concentrate its efforts on programs and activities that
28result in commercially viable products and services.
29b. Adopt practices and services consistent with free
30market, private sector philosophies.
31c. Ensure economic growth and development throughout the
32state.
33d. Work with businesses and communities to continually
34improve the economic development climate along with the
35economic well-being and quality of life for Iowans.
-2- 1e. Coordinate with other state agencies to ensure that they
2are attentive to the needs of an entrepreneurial culture.
3f. Establish a strong and aggressive marketing image to
4showcase Iowa’s workforce, existing industry, and potential.
5A priority shall be placed on recruiting new businesses,
6business expansion, and retaining existing Iowa businesses.
7Emphasis shall be placed on entrepreneurial development through
8helping entrepreneurs secure capital, and developing networks
9and a business climate conducive to entrepreneurs and small
10businesses.
11g. Encourage the development of communities and quality of

13h. Prepare communities for future growth and development
14through development, expansion, and modernization of

22close of the fiscal year shall not revert but shall remain
23available for expenditure for the purposes designated in this
24subsection until the close of the succeeding fiscal year.
252. FINANCIAL ASSISTANCE RESTRICTIONS
26a. A business creating jobs through moneys appropriated in
27subsection 1 shall be subject to contract provisions requiring
28new and retained jobs to be filled by individuals who are
29citizens of the United States who reside within the United
30States, or any person authorized to work in the United States
31pursuant to federal law, including legal resident aliens
32residing in the United States.
33b. Any vendor who receives moneys appropriated in
34subsection 1 shall adhere to such contract provisions and
35provide periodic assurances as the state shall require that the
-4-1jobs are filled solely by citizens of the United States who
2reside within the United States, or any person authorized to
3work in the United States, pursuant to federal law, including
4legal resident aliens residing in the United States.
5c. A business that receives financial assistance from
6the authority from moneys appropriated in subsection 1 shall
7only employ individuals legally authorized to work in this
8state. In addition to all other applicable penalties provided
9by current law, all or a portion of the assistance received
10by a business which is found to knowingly employ individuals
11not legally authorized to work in this state is subject to
12recapture by the authority.
133. USES OF APPROPRIATIONS
14a. From the moneys appropriated in subsection 1, the
15authority may provide financial assistance in the form of a
16grant to a community economic development entity for conducting
17a local workforce recruitment effort designed to recruit former
18citizens of the state and former students at colleges and
19universities in the state to meet the needs of local employers.
20b. From the moneys appropriated in subsection 1, the
21authority may provide financial assistance to early stage
22industry companies being established by women entrepreneurs.
23c. From the moneys appropriated in subsection 1, the
24authority may provide financial assistance in the form of
25grants, loans, or forgivable loans for advanced research and
26commercialization projects involving value-added agriculture,
27advanced technology, or biotechnology.
28d. The authority shall not use any moneys appropriated in
29subsection 1 for purposes of providing financial assistance for
30the Iowa green streets pilot project or for any other program
31or project that involves the installation of geothermal systems
32for melting snow and ice from streets or sidewalks.
334.WORLD FOOD PRIZE
34In lieu of the standing appropriation in section 15.368,
35there is appropriated from the general fund of the state to the

20details the amount of every direct loan, forgivable loan,
21tax credit, tax exemption, tax refund, grant, or any other
22financial assistance awarded to a person during the prior
23fiscal year by the authority under an economic development
24program administered by the authority. The report shall
25identify the county where the project associated with each such
26award is located.
27 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the
28moneys collected by the insurance division in excess of the
29anticipated gross revenues under section 505.7, subsection
303, during the fiscal year beginning July 1, 2021, $100,000
31shall be transferred to the economic development authority for
32insurance economic development and international insurance
33economic development.
34 Sec. 7. IOWA FINANCE AUTHORITY.
351. There is appropriated from the general fund of the state

26fee allowed under this subsection are appropriated to the

28beginning July 1, 2021, and ending June 30, 2022, the following
29amount, or so much thereof as is necessary, to be used for the
30purposes designated:
31In consultation with the workforce development board, for
32funding of the Iowa employer innovation program which shall
33match eligible employer moneys to expand opportunities for
34education and training leading to high-demand jobs and to
35encourage Iowa employers, community leaders, and others to

2pools throughout the state, and for future ready Iowa education
3and outreach:

5Of the moneys appropriated in this subsection, an amount
6to be determined by the department of workforce development
7in consultation with the workforce development board shall be

92. Notwithstanding section 8.33, moneys appropriated in

11end of the fiscal year shall not revert but shall remain
12available for expenditure for the purposes designated until the
13close of the succeeding fiscal year.
14 Sec. 14. UNEMPLOYMENT COMPENSATION RESERVE FUND —
15FIELD OFFICES. Notwithstanding section 96.9, subsection 8,
16paragraph “e”, there is appropriated from interest earned on
17the unemployment compensation reserve fund to the department
18of workforce development for the fiscal year beginning July
191, 2021, and ending June 30, 2022, the following amount, or
20so much thereof as is necessary, to be used for the purposes
21designated:

24 Sec. 15. VIRTUAL ACCESS WORKFORCE DEVELOPMENT OFFICES. The
25department of workforce development shall require a unique
26identification login for all users of workforce development
27centers operated through electronic means.
28 Sec. 16. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding
29section 96.9, subsection 4, paragraph “a”, moneys credited to
30the state by the secretary of the treasury of the United
31States pursuant to section 903 of the Social Security
32Act are appropriated to the department of workforce
33development and shall be used by the department for the
34administration of the unemployment compensation program only.
35This appropriation shall not apply to any fiscal year
-14-1beginning after December 31, 2021.
2 Sec. 17. IOWA SKILLED WORKER AND JOB CREATION FUND.
31. There is appropriated from the Iowa skilled worker and
4job creation fund created in section 8.75 to the following
5departments, agencies, and institutions for the fiscal year
6beginning July 1, 2021, and ending June 30, 2022, the following
7amounts, or so much thereof as is necessary, to be used for the
8purposes designated:
9a. ECONOMIC DEVELOPMENT AUTHORITY
10(1) For the purposes of providing assistance as described in
11section 15.335B for the high quality jobs program:

13From the moneys appropriated in this subparagraph, the
14economic development authority may use not more than $1,000,000
15for purposes of providing infrastructure grants to main street
16communities under the main street Iowa program and may allocate
17not more than $300,000 for the purposes of supporting statewide
18worker education and quality preapprenticeship programs.
19(2) As a condition of receiving moneys appropriated in
20this lettered paragraph “a”, an entity shall testify upon the
21request of the joint appropriations subcommittee on economic
22development regarding the expenditure of such moneys.
23b. STATE BOARD OF REGENTS AND REGENTS INSTITUTIONS
24(1) STATE BOARD OF REGENTS. For capacity building
25infrastructure in areas related to technology
26commercialization, marketing and business development
27efforts in areas related to technology commercialization,
28entrepreneurship, and business growth, and infrastructure
29projects and programs needed to assist in implementation of
30activities under chapter 262B:

32(a) Of the moneys appropriated pursuant to this
33subparagraph (1), 35 percent shall be allocated for Iowa state
34university of science and technology, 35 percent shall be
35allocated for the state university of Iowa, and 30 percent

2(b) The institutions shall provide a one-to-one match
3of additional moneys for the activities funded with moneys
4appropriated under this subparagraph (1).
5(c) The state board of regents shall submit a report by
6January 15, 2022, to the governor and the general assembly
7regarding the activities, projects, and programs funded with
8moneys appropriated under this subparagraph (1). The report
9shall be provided in an electronic format and shall include a
10list of metrics and criteria mutually agreed to in advance by
11the board of regents and the economic development authority.
12The metrics and criteria shall allow the governor’s office and
13the general assembly to quantify and evaluate the progress
14of the board of regents institutions with regard to their
15activities, projects, and programs in the areas of technology
16commercialization, entrepreneurship, regional development, and
17market research.
18(2) IOWA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY. For
19small business development centers, the research park, and the
20center for industrial research and service, and for not more
21than the following full-time equivalent positions:

24(a) Of the moneys appropriated in this subparagraph (2),
25Iowa state university of science and technology shall allocate
26at least $735,728 for purposes of funding small business
27development centers. Iowa state university of science and
28technology may allocate the appropriated moneys to the various
29small business development centers in any manner necessary to
30achieve the purposes of this subparagraph.
31(b) Iowa state university of science and technology shall
32do all of the following:
33(i) Direct expenditures for research toward projects that
34will provide economic stimulus for Iowa.
35(ii) Provide emphasis to providing services to Iowa-based

2(c) It is the intent of the general assembly that the
3industrial incentive program focus on Iowa industrial sectors
4and seek contributions and in-kind donations from businesses,
5industrial foundations, and trade associations, and that moneys
6for the center for industrial research and service industrial
7incentive program shall be allocated only for projects which
8are matched by private sector moneys for directed contract
9research or for nondirected research. The match required of
10small businesses as defined in section 15.102, subsection 10,
11for directed contract research or for nondirected research
12shall be $1 for each $3 of state funds. The match required
13for other businesses for directed contract research or
14for nondirected research shall be $1 for each $1 of state
15funds. The match required of industrial foundations or trade
16associations shall be $1 for each $1 of state funds.
17(d) Iowa state university of science and technology shall
18report annually to the general assembly the total amount of
19private contributions, the proportion of contributions from
20small businesses and other businesses, and the proportion for
21directed contract research and nondirected research of benefit
22to Iowa businesses and industrial sectors.
23(3) STATE UNIVERSITY OF IOWA. For the state university of
24Iowa research park and for university of Iowa pharmaceuticals
25located at the research park, including salaries, support,
26maintenance, equipment, and miscellaneous purposes, and for not
27more than the following full-time equivalent positions:

24(6) As a condition of receiving moneys appropriated in
25this lettered paragraph “b”, an entity shall testify upon the
26request of the joint appropriations subcommittee on economic
27development regarding the expenditure of such moneys.
28c. DEPARTMENT OF WORKFORCE DEVELOPMENT
29To develop a long-term sustained program to train unemployed
30and underemployed central Iowans with skills necessary to
31advance to higher-paying jobs with full benefits:

26digital agriculture, vaccines, and medical devices, including
27salaries, support, maintenance, and miscellaneous purposes, and
28for not more than the following full-time equivalent positions:

17subsection 1, paragraphs “a” and “b”, that remain unencumbered
18or unobligated at the close of the fiscal year shall not revert
19but shall remain available for expenditure for the purposes
20designated until the close of the succeeding fiscal year.
21DIVISION II
22BEER AND LIQUOR CONTROL FUND — TOURISM
23 Sec. 19. Section 123.17, Code 2021, is amended by adding the
24following new subsection:
25 NEW SUBSECTION. 6A. a. After any transfers provided for in
26subsections 3, 5, and 6, and before any other transfer to the
27general fund, the department of commerce shall transfer to the
28economic development authority from the beer and liquor control
29fund one million dollars annually for a statewide tourism
30marketing campaign.
31b. As part of the statewide tourism marketing campaign
32pursuant to paragraph “a”, the economic development authority
33shall issue a single request for proposals to select an entity
34located in this state for a statewide effort to leverage public
35and private partnerships to market and promote the state as a
-20-1travel destination.
2EXPLANATION
3The inclusion of this explanation does not constitute agreement with
4the explanation’s substance by the members of the general assembly.
5DIVISION I — FY 2021-2022 APPROPRIATIONS. This bill
6appropriates moneys for the fiscal year 2021-2022 from the
7general fund of the state to the department of cultural
8affairs, the economic development authority, the Iowa
9finance authority, the public employment relations board, the
10department of workforce development, Iowa state university of
11science and technology, the state university of Iowa, and the
12university of northern Iowa.
13The bill appropriates moneys for the fiscal year 2021-2022
14from the Iowa skilled worker and job creation fund created in
15Code section 8.75 to the economic development authority, the
16department of workforce development, and the state board of
17regents and institutions under the control of the board.
18For the fiscal year 2021-2022, the bill limits standing
19appropriations established in the Code for the world food
20prize, certain operational support grants, community cultural
21grants, and regional tourism marketing.
22The bill transfers $100,000 of the moneys collected by the
23insurance division in excess of the anticipated gross revenues
24under Code section 505.7 to the economic development authority.
25The bill appropriates moneys for the fiscal year 2021-2022
26from the special employment security contingency fund to the
27department of workforce development.
28The bill appropriates interest earned on the unemployment
29compensation reserve fund for the fiscal year 2021-2022 to the
30department of workforce development.
31Moneys credited to the state by the secretary of treasury
32of the United States pursuant to section 903 of the Social
33Security Act are appropriated to the department of workforce
34development.
35The auditor of state is requested to review the audit of the
-21-1Iowa finance authority performed by the auditor hired by the
2authority.
3The bill requires the economic development authority and the
4department of revenue to submit a joint annual report to the
5general assembly by November 1, 2021, detailing all financial
6assistance awarded in the prior fiscal year.
7DIVISION II — BEER AND LIQUOR CONTROL FUND — TOURISM. The
8bill requires the department of commerce to transfer to the
9economic development authority from the beer and liquor control
10fund $1 million annually for a statewide tourism marketing
11campaign. The transfer occurs after certain specified
12transfers from the fund and before other specified transfers.
13As part of the tourism marketing campaign, the authority
14must issue a single request for proposals to select an entity
15located in this state for a statewide effort to leverage public
16and private partnerships to market and promote the state as a
17travel destination.
