2vehicles, and vessels of surviving spouses.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321G.31, subsection 1, Code 2021, is
2amended to read as follows:
   31.  If ownership of a snowmobile is transferred by
4operation of law, such as by inheritance, order in bankruptcy,
5insolvency, replevin, or execution sale, the transferee, within
6thirty days after acquiring the right to possession of the
7snowmobile, shall mail or deliver to the county recorder of
8the transferee’s county of residence satisfactory proof of
9ownership as the county recorder requires, together with an
10application for a new certificate of title, and the required
11fee. However, if the transferee is the surviving spouse of the
12deceased owner, the county recorder shall waive the required
13fee.

14   Sec. 2.  Section 321I.33, subsection 1, Code 2021, is amended
15to read as follows:
   161.  If ownership of an all-terrain vehicle is transferred by
17operation of law, such as by inheritance, order in bankruptcy,
18insolvency, replevin, or execution sale, the transferee,
19within thirty days after acquiring the right to possession of
20the all-terrain vehicle, shall mail or deliver to the county
21recorder of the transferee’s county of residence satisfactory
22proof of ownership as the county recorder requires, together
23with an application for a new certificate of title, and the
24required fee. However, if the transferee is the surviving
25spouse of the deceased owner, the county recorder shall waive
26the required fee.

27   Sec. 3.  Section 462A.82, subsection 1, Code 2021, is amended
28to read as follows:
   291.  If ownership of a vessel is transferred by operation of
30law, such as by inheritance, order in bankruptcy, insolvency,
31replevin, execution sale, or in compliance with section 578A.7,
32the transferee, within thirty days after acquiring the right
33to possession of the vessel by operation of law, shall mail or
34deliver to the county recorder satisfactory proof of ownership
35as the county recorder requires, together with an application
-1-1for a new certificate of title, and the required fee. A title
2tax is not required on these transactions. However, if the
3transferee is the surviving spouse of the deceased owner, the
4county recorder shall waive the required fee.

5EXPLANATION
6The inclusion of this explanation does not constitute agreement with
7the explanation’s substance by the members of the general assembly.
   8Under current law, when ownership of a snowmobile,
9all-terrain vehicle (ATV), or vessel is transferred by
10operation of law, such as by inheritance, order in bankruptcy,
11insolvency, replevin, or execution sale, the transferee
12must pay a required certificate of title fee as part of the
13application process to transfer ownership. The fee is paid to
14the county recorder.
   15This bill requires that if the transferee is the surviving
16spouse of the deceased owner, the county recorder must waive
17the required fee.
   18The title fee for snowmobiles and ATVs is $10 and the title
19fee for vessels is $5.
