3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 123.41, subsection 1, Code 2021, is
2amended to read as follows:
31. a. Each completed application to obtain or renew a
4manufacturer’s license shall be submitted to the division
5electronically, or in a manner prescribed by the administrator,
6and shall be accompanied by a fee of three hundred fifty
7dollars payable to the division. The administrator may in
8accordance with this chapter grant and issue to a manufacturer
9a manufacturer’s license, valid for a one-year period after
10date of issuance, which shall allow the manufacture, storage,
11and wholesale disposition and sale of alcoholic liquors to the
12division and to customers outside of the state.
13b. If the facility at which an applicant will barrel mature
14alcoholic liquors is a barge or other waterborne vessel that is
15moored or otherwise located in a lake or other body of water in
16this state, the division shall not require that the applicant’s
17application include address information for the facility.
18In lieu of such information, the division may require the
19application to include the name of the lake or other body of
20water in which the facility is located or, if the lake or body
21of water is unnamed, unique geographic information sufficient
22to specify the identity and location of the facility.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
26This bill prohibits the alcoholic beverages division of the
27department of commerce from requiring, in an application for
28an alcoholic liquor manufacturer’s license, that an applicant
29include address information for a manufacturing facility if
30the facility will be used to barrel mature alcoholic liquors
31and the facility is a barge or other waterborne vessel that is
32moored or otherwise located in a lake or other body of water in
33Iowa. In lieu of address information, the division may include
34identifying information about the lake or body of water as
35specified in the bill.
