4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  COLLECTION OF UNEMPLOYMENT BENEFIT PAYMENTS —
2DISASTER EMERGENCY.
  Notwithstanding section 96.3, subsection
37, and section 96.3, subsection 10, paragraph “d”, the
4department of workforce development shall not pursue the
5recovery of any overpayments of unemployment insurance benefits
6made to any individual who received such benefits to which the
7individual was not entitled without fault on the part of the
8individual if such benefits were paid during the period of a
9declaration of disaster emergency by the governor pursuant to
10section 29C.6 pertaining to COVID-19 as defined in section
11686D.2.
12   Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
13importance, takes effect upon enactment.
14   Sec. 3.  RETROACTIVE APPLICABILITY.  This Act applies
15retroactively to unemployment benefits received on or after
16March 8, 2020.
17EXPLANATION
18The inclusion of this explanation does not constitute agreement with
19the explanation’s substance by the members of the general assembly.
   20This bill prohibits the department of workforce development
21from pursuing the recovery of any overpayments of unemployment
22insurance benefits made to any individual who received such
23benefits to which the individual was not entitled without
24fault on the part of the individual if such benefits were paid
25during the period of a declaration of disaster emergency by the
26governor pertaining to COVID-19.
   27The bill takes effect upon enactment and applies
28retroactively to unemployment benefits received on or after
29March 8, 2020.
