4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 216.7, subsection 2, Code 2021, is
2amended by adding the following new paragraph:
3 NEW PARAGRAPH. c. An action to refuse or deny access to
4a toilet facility, locker room, living facility, showering
5facility, or other area of a public accommodation designated
6for use by persons of one biological sex to a person of the
7other biological sex.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
11This bill amends the Iowa civil rights Act of 1965 contained
12in Code chapter 216. Code section 216.7 relates to unfair
13practices regarding access to public accommodations.
14The bill excludes an action to refuse or deny access to
15a toilet facility, locker room, living facility, showering
16facility, or other area of a public accommodation designated
17for use by persons of one biological sex to a person of the
18other biological sex from the activities which constitute
19unfair or discriminatory practices by a public accommodation
20under Code chapter 216.
