3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 123.46A, subsection 2, paragraph g, Code
22021, is amended to read as follows:
   3g.  Delivery of alcoholic liquor, wine, or beer shall be made
4by the licensee or permittee, or the licensee’s or permittee’s
5employee, and not by a third party or the licensee’s or
6permittee’s agent
.
7   Sec. 2.  Section 123.46A, subsection 2, paragraph i, Code
82021, is amended by striking the paragraph.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill authorizes the delivery of alcoholic liquor,
13wine, or beer by the agent of a licensee or permittee, if
14the licensee or permittee is authorized by the alcoholic
15beverages division to make such deliveries. Under current law,
16third parties cannot make such deliveries for a licensee or
17permittee.
   18The bill strikes a requirement that deliveries of alcoholic
19liquor, wine, or beer be made in a vehicle owned, leased, or
20under the control of the licensee or permittee.
