3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  279.73  Water bottle filling
2stations — lead testing — signage.
   31.  The board of directors of a school district shall install
4at least one water bottle filling station designed to prevent
5exposure to lead at each attendance center for each one hundred
6students enrolled at the attendance center. The board shall
7annually conduct testing for the presence of lead at each
8filling station. The board shall post the results of the
9testing on the board’s internet site.
   102.  The board shall post a sign near each faucet in an
11attendance center which indicates that the faucet is not
12suitable for drinking. Such signage may indicate permitted
13uses for such a faucet.
14   Sec. 2.  Section 298.3, subsection 1, Code 2021, is amended
15by adding the following new paragraphs:
16   NEW PARAGRAPH.  n.  Installation of water bottle filling
17stations, lead testing, and posting of signage pursuant to
18section 279.73.
19   NEW PARAGRAPH.  o.  Conducting testing for the presence
20of lead in a faucet in an attendance center that is used for
21the preparation of food or for drinking. This paragraph is
22repealed July 1, 2023.
23   Sec. 3.  Section 423F.3, subsection 6, paragraph a, Code
242021, is amended by adding the following new subparagraphs:
25   NEW SUBPARAGRAPH.  (5)  Additionally, “school infrastructure”
26includes installation of water bottle filling stations, lead
27testing, and posting of signage pursuant to section 279.73.
28   NEW SUBPARAGRAPH.  (6)  Additionally, “school infrastructure”
29includes conducting testing for the presence of lead in a
30faucet in an attendance center that is used for the preparation
31of food or for drinking. This subparagraph is repealed July
321, 2023.
33   Sec. 4.  LEAD TESTING OF SCHOOL FAUCETS.  No later than June
3430, 2023, the board of directors of a school district shall
35conduct a test for the presence of lead in each faucet in an
-1-1attendance center that is used for the preparation of food or
2for drinking. The board shall post the results of the testing
3on the board’s internet site.
4   Sec. 5.  STATE MANDATE FUNDING SPECIFIED.  In accordance
5with section 25B.2, subsection 3, the state cost of requiring
6compliance with any state mandate included in this Act shall be
7paid by a school district from a physical plant and equipment
8levy under section 298.2, from revenues from the secure an
9advanced vision for education fund under chapter 423F, or any
10funds available pursuant to federal law. This specification of
11the payment of the state cost shall be deemed to meet all of the
12state funding-related requirements of section 25B.2, subsection
133, and no additional state funding shall be necessary for the
14full implementation of this Act by and enforcement of this Act
15against all affected school districts.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill requires a school board to install at least one
20water bottle filling station designed to prevent exposure to
21lead at each attendance center for each 100 students enrolled
22at the attendance center. The bill requires a board to
23annually conduct testing for the presence of lead at each
24filling station and post the results of the testing on the
25board’s internet site.
   26The bill requires a school board to post a sign near each
27faucet in an attendance center which indicates that the faucet
28is not suitable for drinking.
   29The bill requires a school board to conduct a test for the
30presence of lead in each faucet in an attendance center that is
31used for the preparation of food or for drinking no later than
32June 30, 2023, and post the results on the board’s internet
33site.
   34The bill may include a state mandate as defined in Code
35section 25B.3. The bill requires that the state cost of
-2-1any state mandate included in the bill be paid by a school
2district from a physical plant and equipment levy under Code
3section 298.2, from revenues from the secure an advanced
4vision for education fund under Code chapter 423F, or any
5funds available pursuant to federal law. The specification
6is deemed to constitute state compliance with any state
7mandate funding-related requirements of Code section 25B.2.
8The inclusion of this specification is intended to reinstate
9the requirement of school districts to comply with any state
10mandates included in the bill.
   11The bill authorizes school districts to use revenues from
12the physical plant and equipment levy under Code section 298.2
13or from the secure an advanced vision for education fund under
14Code chapter 423F to comply with the requirements in the bill.
