3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 29A.8A, Code 2021, is amended by adding
2the following new subsection:
3 NEW SUBSECTION. 1A. The governor shall decline to order the
4military forces of the national guard to national guard duty in
5circumstances where the national guard is expected to engage in
6combat and no declaration of war has been issued by Congress
7under Article I, section 8, clause 11 of the Constitution of
8the United States.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
12This bill relates national guard duty under specific
13circumstances.
14The bill requires the governor to deny federal use of the
15national guard in circumstances where the national guard is
16expected to engage in combat and Congress has not issued an
17official declaration of war.
