Senate Study Bill 1090 - IntroducedA Bill ForAn Act 1relating to the statute of limitations for recovery

3veterinarian.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  169.21  Limitations of actions.
   2An action for professional negligence or malpractice for
3injuries to a person or property against an individual licensed
4under this chapter shall not be brought more than two years
5after the date on which the claimant knew, or through the use
6of reasonable diligence should have known, or received notice
7in writing of the existence of, the injury for which damages
8were sought in the action, whichever of the dates occurs first.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill provides a statute of limitations for an action
13brought for professional negligence or malpractice against a
14person licensed to practice veterinary medicine.
   15The bill provides that a person has two years after the date
16the claimant knew, should have known, or received notice of the
17injury for which damages are being sought to bring an action
18against a person licensed to practice veterinary medicine.
   19Under current law, Code section 614.1(4) provides that
20injuries to property shall be brought within five years of the
21injury.
