Senate Study Bill 1066 - IntroducedA Bill ForAn Act 1relating to goose hunting on private property.
2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 481A.5, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  3.  Additional hunting restrictions caused
4by the establishment of a refuge area for any wild goose shall
5not apply to a person hunting on private property during any
6established goose hunting season except that private property
7located within a closed area adjacent to a wild goose refuge
8area shall not be used to allow goose hunting for profit.
9   Sec. 2.  Section 481A.7, Code 2021, is amended to read as
10follows:
   11481A.7  Hunting on game refuges.
   121.  It Except as provided in section 481A.5, subsection 3, it
13 shall be unlawful to hunt, pursue, kill, trap or take any wild
14animal, bird, or game on any state game refuge so established
15at any time of the year, and no one shall carry firearms
16thereon, providing, however, that predatory birds and animals
17may be killed or trapped under the authority and direction of
18the director.
   192.  The commission may specify the distance from a state game
20refuge where shooting is prohibited, and shall have notice of
21same posted at such distance in conspicuous places around the
22refuge, provided, however, this prohibition shall not apply to
23owners or tenants a person hunting on their own land outside
24of a state game refuge
 private property. The commission may
25prohibit shooting at any reasonable distance from a state game
26refuge deemed necessary to accomplish the purposes for which
27the refuge is established.
28   Sec. 3.  Section 481A.39, Code 2021, is amended to read as
29follows:
   30481A.39  Biological balance maintained.
   311.  The commission is designated the sole agency to determine
32the facts as to whether biological balance does or does not
33exist. The commission shall, by administrative rule, extend,
34shorten, open, or close seasons and set, increase, or reduce
35catch limits, bag limits, size limits, possession limits, or
-1-1territorial limitations or further regulate taking conditions
2in accordance with sound fish and wildlife management
3principles.
   42.  Additional hunting restrictions caused by the
5establishment of a restricted area for any wild goose, pursuant
6to subsection 1 of this section, shall not apply to a person
7hunting on private property during any established goose
8hunting season.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill relates to goose hunting on private property.
   13Current law allows the department of natural resources to
14establish state game refuges on any land owned by the state
15to effect sound wildlife management, among other reasons. In
16establishing a game refuge, the department may promulgate rules
17that restrict hunting on private property.
   18The bill exempts a person hunting on private property from
19additional restrictions caused by the establishment of a refuge
20area or restricted area for any wild goose except that private
21property located within a closed area adjacent to a wild goose
22refuge area shall not be used to allow goose hunting for
23profit. A person hunting on private property must still adhere
24to other hunting restrictions that would exist regardless of
25the establishment of a refuge area or restricted area for any
26wild goose.
