3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 481A.54, Code 2021, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  2A.  A person shall not discharge a
4weapon from a snowmobile, all-terrain vehicle, or any other
5motor vehicle, as defined in section 321.1, except that a
6nonambulatory person may discharge a firearm from a snowmobile
7or all-terrain vehicle as provided in section 321G.13,
8subsection 2, paragraph “c”, or section 321I.14, subsection
92, paragraph “c”. This subsection does not prohibit a person
10who uses a stationary motor-driven land conveyance intended to
11accommodate that person’s physical disability from hunting from
12the conveyance, as provided by rules adopted by the department
13pursuant to section 483A.8C. For purposes of this subsection,
14“weapon” means a firearm, bow and arrow, crossbow, or any other
15hunting weapon.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill relates to discharging a weapon from a motor
20vehicle.
   21Current law generally prohibits discharging a firearm from
22a snowmobile or all-terrain vehicle. The bill prohibits a
23person from discharging a weapon from a snowmobile, all-terrain
24vehicle, or any other motor vehicle except that a nonambulatory
25person may discharge a firearm from a snowmobile or all-terrain
26vehicle while lawfully hunting if the person is not operating
27or riding a moving snowmobile or all-terrain vehicle. The bill
28does not prohibit a person who uses a stationary motor-driven
29land conveyance intended to accommodate that person’s
30disability from hunting from the conveyance.
