4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  135.39E  Fluoridation in public
2water supply — notice of discontinuance.
   31.  At least ninety days prior to taking any action to
4discontinue fluoridation in its water supply, an owner or
5operator of a public water supply system, as defined in section
6455B.171, shall provide notice to all of the following:
   7a.  The local board.
   8b.  The department.
   9c.  The public water supply system’s customers.
   102.  In order to provide notice to its customers, the owner or
11operator of the public water supply system shall place a notice
12on each customer’s water bill or provide notice in a way that
13is reasonably calculated so that all customers will receive the
14notice.
15EXPLANATION
16The inclusion of this explanation does not constitute agreement with
17the explanation’s substance by the members of the general assembly.
   18This bill relates to requirements for providing notice
19prior to discontinuing fluoridation in a public water supply
20system. For purposes of the bill, a public water supply system
21provides to the public piped water for human consumption and
22has at least 15 service connections or regularly serves at
23least 25 individuals. A public water supply system includes
24any source of water and any collection, treatment, storage, and
25distribution facilities under control of the operator of the
26system and used primarily in connection with the system, and
27any collection or pretreatment storage facilities not under
28such control that are used primarily in connection with the
29system.
   30The bill requires the owner or operator of a public water
31supply system to provide notice to the local board of health,
32the department of public health, and the public water supply
33system’s customers at least 90 days prior to taking any action
34to discontinue fluoridation in the system’s water supply. The
35owner or operator of the system shall provide notice to its
-1-1customers by placing a notice on each customer’s water bill or
2by providing notice in a way that is reasonably calculated so
3that all customers will receive the notice.
   4By operation of law, a person who knowingly violates the
5provisions of the bill is guilty of a simple misdemeanor. A
6simple misdemeanor is punishable by confinement for no more
7than 30 days and a fine of at least $105 but not more than $855.
