3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 137D.1, subsection 3, Code 2021, is
2amended to read as follows:
33. “Home bakery” means a business on the premises of
4a residence in which prepared food is created for sale or
5resale, for consumption off the premises, if the business has
6gross annual sales of prepared food of less than thirty-five
7thousand dollars. However, “home bakery” does not include
8a residence in which food is prepared to be used or sold by
9churches, fraternal societies, charitable organizations, or
10civic organizations.
11EXPLANATION
12The inclusion of this explanation does not constitute agreement with
13the explanation’s substance by the members of the general assembly.
14This bill relates to the operation of home bakeries licensed
15by the department of inspections and appeals. The bill removes
16a provision in the definition of “home bakery” limiting such
17businesses to annual sales of less than $35,000.
