4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  27B.1  Definition.
   2For purposes of this chapter, “search warrant” means a search
3warrant issued pursuant to chapter 808.
4   Sec. 2.  NEW SECTION.  27B.2  Recording devices — private
5property.
   6A state agency, state official, or state employee shall not
7place a photo, video, or audio recording device on private
8property in this state without obtaining either a search
9warrant or express permission from an owner of the property.
10   Sec. 3.  NEW SECTION.  27B.3  Removal of devices.
   11On or before July 1, 2021, a state agency, state official,
12or state employee that has placed a photo, video, or audio
13recording device on private property in this state in violation
14of section 27B.2 shall cease using and remove the photo, video,
15or audio recording device.
16   Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of immediate
17importance, takes effect upon enactment.
18EXPLANATION
19The inclusion of this explanation does not constitute agreement with
20the explanation’s substance by the members of the general assembly.
   21This bill prohibits a state agency, state official, or state
22employee from placing a photo, video, or audio recording device
23on private property in Iowa without obtaining either a search
24warrant or express permission from an owner of the property.
   25The bill requires a state agency, state official, or state
26employee that has placed a photo, video, or audio recording
27device on private property in violation of the bill to cease
28using and remove the photo, video, or audio recording device on
29or before July 1, 2021.
   30The bill takes effect upon enactment.
