House Study Bill 60 - IntroducedA Bill ForAn Act 1concerning the authority of a native wine manufacturer
2to sell native wine for on-premises consumption.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 123.176, subsection 5, Code 2021, is
2amended to read as follows:
   35.  Notwithstanding any other provision of this chapter, a
4person engaged in the business of manufacturing native wine
5may sell native wine at retail for consumption on the premises
6of the manufacturing facility manufacturer or in a retail
7establishment operated by the manufacturer
by applying for a
8class “C” native wine permit as provided in section 123.178B.
9 A manufacturer of native wine may be granted not more than
10one two class “C” native wine permit permits. A manufacturer
11of native wine may be issued a class “C” native wine permit
12regardless of whether the manufacturer is also a manufacturer
13of beer pursuant to a class “A” beer permit or a manufacturer
14of native distilled spirits pursuant to a class “A” native
15distilled spirits license.
16EXPLANATION
17The inclusion of this explanation does not constitute agreement with
18the explanation’s substance by the members of the general assembly.
   19This bill concerns manufacturers of native wines.
   20The bill authorizes a manufacturer of native wine to be
21granted up to two class “C” native wine permits to sell
22native wine at retail for consumption on the premises of the
23manufacturer or in a retail establishment operated by the
24manufacturer. Current law allows a manufacturer one class
25“C” native wine permit to sell native wine at retail for
26consumption on the premises of the manufacturing facility.
