Senate File 79 - IntroducedA Bill ForAn Act 1regarding driving privileges of persons issued a special
2minor’s driver’s license who reside or are employed on a
3farm, and making penalties applicable.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.194, subsection 2, paragraph a, Code
22021, is amended by adding the following new subparagraph:
3   NEW SUBPARAGRAPH.  (03)  If the licensee resides on a farm
4or is employed for compensation on a farm in this state,
5the licensee may operate a motor vehicle during the hours
6of 5:00 a.m.to 10:00 p.m.for the purpose of assisting the
7person’s parents, guardians, or employers with farm work or in
8connection with any farm job, employment, or other farm-related
9work, including traveling to or from the location of the farm
10work, provided the licensee operates the vehicle over the most
11direct and accessible route between the point of origin and
12the destination and the driving distance between the point of
13origin and the destination is no more than fifty miles.
14   Sec. 2.  Section 321.194, subsection 2, paragraph a,
15subparagraph (3), Code 2021, is amended to read as follows:
   16(3)  To a service station for the purpose of refueling, so
17long as the service station is the station closest to the route
18on which the licensee is traveling under subparagraph (1), or
19 (2), or (03).
20   Sec. 3.  Section 321.194, subsection 3, paragraph b, Code
212021, is amended to read as follows:
   22b.  Upon receipt of a statement of necessity, the department
23shall issue the driver’s license provided the applicant is
24otherwise eligible for issuance of the license. The fact that
25the applicant resides at a distance less than one mile from the
26applicant’s school of enrollment is prima facie evidence of
27the nonexistence of necessity for the issuance of a license.
 28However, the distance between the applicant’s residence and
29school of enrollment shall not be considered if the applicant
30resides on a farm or is employed for compensation on a farm.

31EXPLANATION
32The inclusion of this explanation does not constitute agreement with
33the explanation’s substance by the members of the general assembly.
   34Under current law, a person holding a special minor’s
35driver’s license is allowed to operate a motor vehicle during
-1-1the hours of 5:00 a.m.to 10:00 p.m.between the licensee’s
2residence, schools of enrollment, bus stops, and sites,
3facilities, or schools designated by the licensee’s district
4or school of enrollment for the accommodation of the school’s
5extracurricular activities, with certain limitations. This
6bill allows a person holding a special minor’s driver’s license
7who resides on a farm or is employed for compensation on a
8farm in this state to operate a motor vehicle during the hours
9of 5:00 a.m.to 10:00 p.m.for the purpose of assisting the
10person’s parents, guardians, or employers with farm work or in
11connection with any farm job, employment, or other farm-related
12work, including traveling to or from the location of the farm
13work, provided the person operates the vehicle over the most
14direct and accessible route between the point of origin and
15the destination and the driving distance between the point of
16origin and the destination is no more than 50 miles. The bill
17also allows a licensee to operate a motor vehicle to a service
18station along the associated routes.
   19Under current law, an application for a special minor’s
20driver’s license must be accompanied by a statement from
21the applicant’s school of enrollment certifying that a need
22exists for the license. The fact that an applicant resides
23at a distance less than one mile from the applicant’s school
24of enrollment is prima facie evidence of the nonexistence of
25necessity for the issuance of the license. However, the bill
26provides that the distance between the applicant’s residence
27and school of enrollment shall not be considered regarding the
28existence of a necessity if the applicant resides on a farm or
29is employed for compensation on a farm.
   30A violation of Code section 321.194 is punishable by a
31scheduled fine of $70.
