3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  307.48A  Overtime leave or pay
2earned by highway maintenance employees.
   31.  As used in this section, unless the context otherwise
4requires:
   5a.  “Highway maintenance employee” means an employee of the
6maintenance bureau of the department’s operations division
7who provides maintenance services on primary roads, including
8but not limited to highway technicians, highway technician
9associates, equipment operators, and garage operation
10assistants.
   11b.  “Workweek” means the seven-day period from Friday at
12midnight to Thursday at 11:59 p.m.
   132.  A highway maintenance employee who works more than forty
14hours during a workweek shall not be prohibited from earning
15overtime leave or overtime pay during the workweek due to,
16or have the employee’s overtime leave or overtime pay earned
17during the workweek offset by, any leave taken during that same
18workweek, including but not limited to vacation leave, sick
19leave, compensatory leave, or overtime leave. However, if a
20highway maintenance employee works on the same day the employee
21has also taken leave, any overtime leave or overtime pay earned
22for the day may be offset by any leave taken that day.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
   26This bill relates to overtime leave or pay earned by
27department of transportation highway maintenance employees.
28The bill defines the terms “highway maintenance employee” and
29“workweek”. Under the bill, a highway maintenance employee
30who works more than 40 hours during a workweek shall not be
31prohibited from earning overtime leave or overtime pay during
32the workweek due to, or have the employee’s overtime leave or
33overtime pay earned during the workweek offset by, any leave
34taken during that same workweek. However, the bill provides
35that if a highway maintenance employee works on the same day
