4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  307.50  Scenic byways enhancement
2fund.
   31.  A scenic byways enhancement fund is created in the
4state treasury under the control of the department. The fund
5shall consist of moneys transferred to the fund pursuant
6to section 321.44B and any other moneys appropriated to or
7deposited in the fund. Moneys in the fund are appropriated to
8the department for the support, development, maintenance, and
9enhancement, including but not limited to litter prevention, of
10the scenic byways of this state.
   112.  Notwithstanding section 8.33, moneys in the fund
12that remain unencumbered or unobligated at the close of a
13fiscal year shall not revert but shall remain available for
14expenditure for the purposes designated. Notwithstanding
15section 12C.7, subsection 2, interest or earnings on moneys in
16the fund shall be credited to the fund.
17   Sec. 2.  NEW SECTION.  321.44B  Voluntary contribution —
18scenic byways enhancement fund — amount retained by county
19treasurer.
   20For each application for registration or renewal, the
21county treasurer or the department shall request through
22use of a written form, and, if the application is made in
23person, through verbal communication, that an applicant make a
24voluntary contribution of one dollar or more, computed to the
25nearest whole dollar, to the scenic byways enhancement fund
26established in section 307.50. One hundred percent of the
27moneys collected by the county and one hundred percent of the
28moneys collected by the department in the form of contributions
29shall be remitted to the treasurer of state for deposit in the
30scenic byways enhancement fund to be used for the purposes
31specified for the fund. However, up to five percent of the
32moneys collected by the county may be retained by the county
33treasurer for deposit in the general fund of the county.
34The director shall adopt rules pursuant to chapter 17A to
35administer this section.

1   Sec. 3.  Section 331.557, subsection 1, Code 2021, is amended
2to read as follows:
   31.  Issue, renew, and replace lost or damaged vehicle
4registration cards or plates and issue and transfer
5certificates of title for vehicles, and collect voluntary
6contributions,
as provided in sections 321.17 to through
7 321.52.
8   Sec. 4.  EFFECTIVE DATE.  This Act takes effect January 1,
92022.
10EXPLANATION
11The inclusion of this explanation does not constitute agreement with
12the explanation’s substance by the members of the general assembly.
   13This bill creates a scenic byways enhancement fund
14and appropriates moneys in the fund to the department of
15transportation (DOT) for the support, development, maintenance,
16and enhancement, including litter prevention, of scenic
17byways. For each application for registration or renewal of
18registration of a motor vehicle, the county treasurer or the
19DOT is required to request that an applicant make a voluntary
20contribution of $1 or more, computed to the nearest whole
21dollar, to the scenic byways enhancement fund. Up to 5 percent
22of the moneys collected by the county may be retained by the
23county treasurer for deposit in the general fund of the county.
   24The bill takes effect January 1, 2022.
