3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 135.166, subsection 2, Code 2021, is
2amended to read as follows:
32. Unless otherwise authorized or required by state or
4federal law, data collected under this section shall not
5include the social security number or name of the individual
6subject of the data.
7EXPLANATION
8The inclusion of this explanation does not constitute agreement with
9the explanation’s substance by the members of the general assembly.
10This bill relates to health data collected and used by
11the department of public health (DPH). Current law directs
12DPH to enter into a memorandum of understanding with a
13contractor selected through a request for proposals process
14to collect, maintain, and disseminate hospital inpatient,
15outpatient, and ambulatory data. Current law also provides
16that unless otherwise authorized by state or federal law, the
17data collected shall not include the social security number
18of the individual subject of the data. Under the bill, data
19prohibited from collection would also include the name of the
20individual subject of the data.
