5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  206.33A  Dicamba — prohibition.
   21.  A person shall not offer for sale, sell, purchase, apply,
3or use the chemical compound dicamba, including any form of
4dicamba which is an ingredient in a pesticide.
   52.  The department, working in conjunction with the
6department of natural resources, shall identify existing stocks
7of dicamba, shall formulate recommendations for the safe
8disposal of existing stocks of dicamba, and shall make those
9recommendations available to the owners of existing stocks of
10dicamba.
11   Sec. 2.  EFFECTIVE DATE.  This Act takes effect January 1,
122022.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16GENERAL. This bill amends Code chapter 206, which
17provides for the regulation of pesticides by the department of
18agriculture and land stewardship (DALS), including provisions
19that prohibit certain chemicals such as chlordane (Code section
20206.32) and daminozide (Code section 206.33) which are utilized
21as pesticides.
   22PROHIBITION. The bill prohibits a person from offering
23for sale, selling, purchasing, applying, or using the
24chemical compound dicamba which is the active ingredient in a
25number of herbicides used to manage post-emergence broadleaf
26weeds (annuals and perennials) when applied to a number of
27agricultural and nonagricultural sites. DALS is required to
28cooperate with the department of natural resources to identify
29existing stocks of dicamba and recommend methods to safely
30dispose of the chemical compound.
   31PENALTY. A person who violates a provision of Code
32chapter 206 is guilty of a serious misdemeanor (Code section
33206.22(2)). A serious misdemeanor is punishable by confinement
34for no more than one year and a fine of at least $430 but not
35more than $2,560.

   1EFFECTIVE DATE. The bill takes effect January 1, 2022.
